10.01.2022 Last night at about 11:20 pm our Principal Solicitor of NC Defence Lawyers, Mr Neil Chow, a casual patron of "The Club" at Kings Cross was shocked to witness first-hand wild scenes of chaos and disorder as a brawl erupted on Bayswater Road which required the calling of the Riot Squad, a continual outpouring of police officers and vehicles to control it and the road to be blocked for close to an hour halting human and vehicle traffic. In the process, pepper spray was forced to... be used on patrons to break up the brawl, 5 police officers were taken to hospital with an assortment of serious injuries and 7 people were taken into custody at Kings Cross and Sydney City Police Station. In one observed instance, some 10 or so police officers surrounded a paddy wagon whilst another 5 or so were inside it with a police officer observed to be using physical force to lay into and restrain a soon-to-be-defendant. The scenes of arrest continued onto Darlinghurst Road where four suspects were surrounded by an overwhelming amount of police officers played out in front of shocked standers-by. 03.01.2022 After a near 2 week trial and 4 day wait for a jury verdict at the District Court, our Principal Solicitor Neil Chow of NC Defence Lawyers instructing learned Counsel was successful this week in achieving an acquittal for our client facing a serious drug importation charge! 02.01.2022 Yesterday at Central Local Court, NC Defence Lawyers achieved another significant victory with bail granted for a client facing the charge of "Aggravated Robbery and Inflicting Actual Bodily Harm" in a second bail application at the Local Court which required to "show cause"!!! That meant three hurdles had to be overcome to be granted bail. The first was that the Court in the same Local Court jurisdiction had to be satisfied that there was either material information or cir...cumstances relevant to the grant of bail which respectively were not present or had changed since the previous bail application. The second was that the Accused, for this serious indictable offence and which he was charged with whilst on bail, had to show why his detention was not justified. And thirdly, in overcoming both hurdles, the Court in having regard to all relevant bail concerns would have to be satisfied that there were no unacceptable risks should the Accused be granted bail. In what seemed an objectively very difficult application, our Principal Solicitor Mr Neil Chow was undeterred, making submissions and presenting material that overcame ALL three hurdles. The overwhelming relief and gratitude that the client and his family expressed for Neil's hard work and fighting spirit in helping the client receive a final opportunity to be out in the community attending to his mental health issues and abiding by his strict bail conditions whilst awaiting trial made NC Defence Lawyers' time and efforts well worth it! 01.01.2022 Today, despite the legislation and likelihood of prospects of success against him, our Principal Solicitor Neil Chow successfully applied for bail for a client on an emergency basis at the Supreme Court of New South Wales who had formerly been refused bail both at the Supreme Court and District Court! Pursuant to sections 74 (1) and (3) of the Bail Act, Neil was able to convince The Presiding Justice that there were grounds constituting material information relevant to the g...rant of bail in the present application that was not presented in the previous application at the Supreme Court and that there had since been a change in relevant circumstances. Neil argued that the additional previous decision by the District Court to refuse bail was limited to its powers under section 69 of the Act and the test of "special facts or circumstances" to justify the (re)hearing of the bail application and subsequent refusal in the District Court did not apply at the Supreme Court. As a result, despite the possibility of our client facing a (further) custodial sentence for his serious offences, he was able to be released to residential rehabilitation to complete an intesnsive program to address his offending behaviour prior to sentence!
