24.01.2022 A very difficult dilemma this week. I have been asked to support a woman at a meeting with her local health district with concerns she has about her recent life saving, emergency hospital care. During that admission her providers decided she did not have capacity to make medical decisions and they had a temporary guardian appointed... only for the time she was in hospital. Her discharge summary says a permanent guardian should be sought. They believe she has an intellectual d...isability and she denies that and will not allow herself to be assessed. There has been no follow through about the guardian from the very people who have the evidence and authority to do this. I would argue, the people who have a duty of care to do it. At the meeting (to support this woman in her plan to challenge the hospital about her claims of bad care and outcomes) is it reasonable to ask the hospital what they have done about their own suggestion that a guardian should be appointed? By way of clarification: The client will not allow any assessment or conversation that would enable the appointment of a guardian. She says she is fine and has no need of a guardian. In hospital she walked out of several attempts she perceived as attempts to assess her. The hospital’s social worker knows she needs a guardian but has done nothing to have one appointed. The client is very confronting and aggressive (noted in her discharge summary, her coordinator’s, carer’s and now my personal experience). When any process or conversation becomes confronting, she threatens to sue (which is her plan Vs the hospital). She forbids her carers from speaking to any providers about her. This question is generated by my concern that someone who maybe in danger because she lacks capacity has not had a guardian appointed. Suggestions welcome.

21.01.2022 OMG. WE DID IT. Woo Bloody Hoo. Following criticism that several radical changes to the National Disability Insurance Scheme could gut the scheme, new Government Services Minister Linda Reynolds will shelve plans to roll out third-party, roughly 3-hour-long independent assessments until a trial is finished and the government has had a good opportunity to examine the feedback Crikey Worm.

17.01.2022 Who thinks the proposal to introduce 3 hour assessments by complete strangers, devoid of the input of the established specialists and supporters is going to be an improvement for NDIS participants? What problem is this a solution for? This article makes some valid points. https://probonoaustralia.com.au//new-ndis-independent-ass/

05.01.2022 SCHEME AGAINST SCHEME Concerns that the Morrison government is attempting to gut the National Disability Insurance Scheme have mounted after Guardian Australia obtained an internal document showing the body in charge of the scheme, the National Disability Insurance Agency, has created a sustainability action taskforce to make short term, immediate changes to slow growth in participant numbers, slow growth in spend per participant and strengthen operational discipline. N...ews of the document, which cites a cost overrun in 2021-22, follows controversial plans to introduce third-party, roughly three-hour-long independent assessments and overhaul the NDIS Act to potentially slash eligibility and greatly expand debt recovery. It also follows revelations by The Saturday Paper that two senior public servants involved in the establishment of robodebt are now, coincidentally, working in the NDIA’s compliance division.
