20.01.2022 Electrical licensing fees update from Building & Energy Weve recently received an update from Building and Energy clarifying some issues around the waiver of electrical licensing fees: From 1 July 2020 until 31 March 2021, you must pay the normal fee when you renew your licence. B&E will then refund you a years worth of your licence. For example, if your licence renewal is for one year, you will get a 100% refund. If it is for 3 years, you will get a 33% refund.... Unfortunately, the refunds will not be paid until the regulations that govern the licence fees are changed. As B&E are unable to tell us when this regulation change will take place, we cant provide you with a date for when you will receive your refunds. B&E initially stated that people who paid their renewals after 1 April were going to be refunded by 30 June however, as the regulations havent been changed as yet, that will no longer be the case. For anyone who paid their renewal during the brief period that B&E did not charge a renewal fee, lucky you! You are in the clear for the next year. 16.01.2022 High Court Ruling on Mondelez Case: Personal Leave Accrual Calculation The recent High Court decision has overturned the Full Federal Court decision that the 10 days of personal/carers leave per year in the National Employment Standards must reflect an employees ordinary hours of work. This High Court decision means that employers (and in particular those dealing with payroll) can return to the accrual of personal/carers leave on an hourly basis. When leave is taken it ...is deducted from the employees accrued paid personal/carers leave on an hourly basis. Further, part-time employees are entitled to 10 notional days of paid personal/carers leave per year, which is calculated as 1/10th of the employees ordinary hours of work in a two-week period. If you updated your payroll systems taking into account the Full Federal Court decision in the Mondelez case last year, you will need to update your system again to ensure that your employees accruals are being recorded correctly. To be eligible for JobKeeper in the 28 September 2020 to 3 January 2021 quarter, an employer needs to show that actual GST turnover has declined in the September 2020 quarter relative to a comparable period (generally the corresponding quarter in 2019). ... 10.01.2022 Business owner imprisoned and fined $550,000 A business owner has been sent to prison and fined more than $550,000 following a workplace fatality in Esperance. Whilst the owner was the first business owner to be sent to prison under the current Occupational Safety and Health Act, please note this prosecution was not made under the new Industrial Manslaughter laws which will come into effect later this year. ... 08.01.2022 Important Change to Electrical Licenses As all contractors would be aware, under the Electrical (Licensing) Regulations 1991, a person who carries on with business as an electrical contractor must have an Electrical Contracting Licence. Where a business structure changes (i.e. an electrical contractor moves from being a sole trader to a Pty Ltd company), that new entity will need to apply for a NEW Electrical Contracting Licence in its own right. ... Previously, entities have been able to transfer a contractors license number from one entity to another if the ownership of that license has remained the same.
