21.01.2022 Words can’t express how thankful we are for such an amazing and thoughtful gift from the lovely Brownings. A stunning bunch of flowers and a $500 voucher to Table 1 Espresso. We are all so excited to go out for lunch together as a team on our last day of work for the year. I can’t believe how big my team is now, we have a new receptionist starting in January and Kohbi has been promoted to an assistant. We also have another team member joining us very soon. My little team will then be 10!

17.01.2022 What is DocuSign and how does it work? DocuSign is an application that assists with the electronic signing of documents which has become increasingly popular during the Covid-19 pandemic. We offer this service to our clients at Next Legal and Conveyancing as we are all about saving our clients time, money and ensuring that their matter is as simple and stress free as possible. ... DocuSign enables us to send our clients links to important documents for signing i.e. Contracts direct to their email. Upon receipt of a link, the client clicks the Review Document button which brings up the document in an internet tab. The document can then be read and signed by clicking the sign here icon on the screen. Once the document is signed we will receive an instant notification and a certificate of completion with the IP address used to sign and other security measures taken.

09.01.2022 Many people assume divorce and property orders are linked and to be dealt with at the same time. Or, that you must be divorced to receive property orders. You do not need to be divorced to obtain property orders or to finalise property matters. You may finalise financial settlement as soon as you separate from your ex-partner and there is no need to wait until you are formally divorced! 09.01.2022 YES! In the decision of Farmer & Bramley 2000 FLC 93-060 there were no assets of value held by the parties at separation. One and a half years after separation the husband won a $5,000,000 lottery. The full Court upheld the decision of the trial judge to adjust the lottery winnings such that the wife received $750,000 of his winnings!

07.01.2022 What are Consent Orders? Consent orders are a written agreement between separated parties that is approved by the Court. Consent orders can relate to both financial settlement and child custody matters. Consent orders have the same legal effect as if they had been made by a judge after a court hearing, but they are made by agreement by the parties without having to attend Court. 05.01.2022 Property Law and Vacant Possession! Vacant possession requires the vendor to remove all chattels (ie furniture, rubbish etc) not included in the sale to allow the purchaser to move straight into the property on settlement. However, the obligation of the seller to provide vacant possession is not absolute and it depends on the circumstances and facts of the individual case as to whether the vendor has satisfied this. For example, leaving some items underneath the house was c...onsidered in a well known case of Nelson v Bellamy (2000) NSWSC 182. The Court found that the items left under the house in this case did not substantially impede the buyer and consequently the buyer was not entitled to terminate the Contract. TIP - we recommend that you take the Contract to your final inspection so you can ensure all inclusions are still present and any exclusions have been removed.

03.01.2022 Buying property with your sibling or friend: We have a lot of clients wanting to purchase property with their sibling(s) or friend(s) and are enquiring as to how this may affect their entitlement to the First Home Buyer Assistance Scheme. If you are a first home buyer and you are purchasing property with a sibling or friend who is not a first home buyer, provided you meet the First Home Buyer Assistance Scheme criteria, you will be entitled to an exemption on your share of the property.

02.01.2022 Identity theft and fraud continues to be one of the most common crimes in Australia, which is why Land Registry Services (LRS) introduced new conveyancing rules under Section 12E of the Real Property Act. These rules stipulate verification of identity (VOI) procedures and the standard for verification of a client’s identity. Your legal representative has an obligation to ensure that the person claiming authority to deal with land is legally permitted to do so. At Next Legal and Conveyancing, we complete our verification process online via an external provider called Infotrack. A secure link will be emailed directly to your email so as to conduct your VOI. Effectively, you will be required to upload a photograph of yourself and photographs of various original identification documents. The letter was a personal congratulations to our success in what has been a very difficult year for businesses and employees.
