21.01.2022 *** Important Changes Affecting Debt Collection *** The office of the Department of Justice & Attorney Generals will on July 1st 2019 make sweeping changes to the way debt collection agencies are able to represent their clients in Queensland Magistrates Court enforcement proceedings. These changes "re-interpret" the rules that we have been following for over 20 years, and they will significantly increase the cost incurred by our clients taking action in the courts to enforce... their debts. In addition to the increased cost, the new procedures will see our clients having to play a much greater role in enforcement proceedings, often delaying what should be a simple streamlined process, a process that is being changed without cause, without justification, and without thought to it's ramifications. Just one of many issues that we can see is that under the new changes, your street address details will have to be published in the footer of all enforcement proceeding documents filed in the court. It goes without saying the not all enforcement proceedings are pleasant, and not all debtors take kindly to you taking legal action against them. Would you rather your address on those documents or ours (as is the case now) ? Despite lobbying the Court Policy Procedure & Legal Unit ("CPPLU") over the past 8 months, we are still yet to receive any satisfactory explanation for the "new way" that the courts are interpreting rules that have existed for two decades. We are now lobbying our local members of parliament, and we are making direct approaches to the Attorney Generals office to ask that some logic be applied to what appears to be bureaucratic madness. We will update you, our clients, on the changes that will affect you and your business in the weeks ahead, that is unless we can get the CPPLU to agree to delay the publishing of its new directions to various court registries throughout Queensland. We will also shortly ask for your support by helping us show the CPPLU how this new direction will adversely affect your business by delaying the enforcement process and increasing the cost of you being able to collect your debts. 21.01.2022 ASIC has just released its Report on Insolvencies for 2017/2018....a few of the noteworthy stats: 84% of insolvencies involve small companies with: - 20 or fewer employees - Assets of $100,000 or less... - 39% with liabilities less than $250,000 - 61% with liabilities greater than $250,000 97% of all small company liquidations result in a return to creditors of between 0 11 cents in the dollar. 15.01.2022 Software development is improving the way businesses manage their receivables, but these "automated" and "smart" systems are not a substitute for proper, timely, consistent personal contact with overdue debtors. 15.01.2022 A couple of very simple fundamental rules to help you get paid faster 1. State your payment terms clearly on your invoice (be loud and proud and don't make customers search the fine print to check the due date) and for new customers, have that discussion with them up front. Few things are as important as having your customers aware of what you expect in regard to payment for your services. 2. Get the details right.... You can’t get paid if the invoice doesn’t get to the right person with the right information. Check that email are correct (watch for email bounces shortly after you send them) and check that the full and correct name is on the invoice, verify customer information using the ABN Lookup website https://abr.business.gov.au/ or ASIC Connect here https://connectonline.asic.gov.au//l/SearchRegisters.jspx 3. Make sure you are communicating with the right person, the person who pays your bills, and include the information that your customers need to make processing your payment easy. That might be job or purchase order numbers, customer reference numbers, quote numbers, descriptions, cost breakdowns or unit prices. 4. Choose invoicing software that allows you to play with your invoice template to get it looking just how you want it. Remember that software that tells you whether an invoice has been viewed by your customer can be handy for avoiding the old I haven’t received it chestnut.
