18.01.2022 So it looks like the Minister is send a generic email back to everybody which is a bit of an insult and doesnt answer the questions that we all have put forward. Please see what information they are trying to feed to us. GENERIC EMAIL FROM MINISTER Thank you for your email dated 21 March 2015 regarding the 2015 pastoral lease exclusions along the Ningaloo coast.... Land along the Ningaloo coast is being excluded from pastoral leases to create a public conservation and recreation reserve. This is being done to guarantee public access and enjoyment of the Ningaloo coast for all Western Australians and visitors for generations to come. It will also allow land management to be integrated with the management of the World Heritage listed Ningaloo Marine Park. The public reserve once created, will ensure that low-cost camping and the unique wilderness experience enjoyed by thousands of Western Australians each year will continue. Camping, surfing, fishing, diving, snorkelling and other forms of recreation will also continue to be provided for. In 2004, five of the six pastoral lessees along the Ningaloo coast signed agreements to exclude a one to two kilometre-wide coastal area from their pastoral leases after 30 June 2015. The Government has subsequently indicated a willingness to substantially reduce the coastal exclusions along the Ningaloo coast to a more practical boundary following natural and built features such as roads and fence lines. The Government is currently negotiating with the lessees to amend their pastoral exclusion agreements accordingly. I am advised that the Minister for Lands, who is responsible for the renewal of pastoral leases, recently wrote to lessees advising them of the options to renew their leases. Pastoralists are well-placed to have an ongoing role in managing the coast given they live nearby. Opportunities for pastoralists to continue managing camping along the Ningaloo coast will be provided. 18.01.2022 Here is another great question that has been asked which we thought may interest all, surname has been removed for their privacy. QUESTION Luke Apr 2nd, 11:19am... Good morning, I was just inquiring as to whether Ningaloo Station had been given any more information from Department of Lands/Ministers, regarding future of their station and their lease renewal. Is it certain that they will lose their station or is the lease able to be renewed this close to the expiry date? Been in contact with DOL who say that the lease will not be renewed but said negotiations were ongoing with the station. Would welcome any feedback. Regards, Luke RESPONSE Hi Luke, Like all pastoral leases in WA Ningaloo Stations lease expire at 2400 hours on June 30, 2015. We have been informed our lease will not be renewed. The land then becomes Unallocated Crown Land [UCL] and the Minister for Lands, under the provisions of the Land Administration Act, 1997 [LAA], can virtually do what he wishes with the land. We have constantly requested he Issue" a pastoral lease, on the same conditions as is currently, to the Lefroy family. Please remember Colin Barnett and Brendon Grylls in opposition signed a written document called an "Agreed Position Paper" where in they stated quote, "There will be no excision of pastoral leases to add to the Ningaloo Marine Park", "Pastoralist will continue to manage the tourism ventures in which they have interests and approval from the Pastoral Lands Board" [as we do] and" The coalition will revoke any legislation where excision enacted by the Gallop Labour government would seek to remove management of any part of the pastoral lease from control of the lease". It seems the Department of Parks and Wildlife is exceptionally powerful to persuade a Minister of the Crown to dishonour a written promise. As all of Ningaloo Stations buildings are heritage listed we receive NO compensation when we leave the station so DPaW end up with a house, shearing shed, shearers quarters, staff quarters, air strip, cyclone shelter, hanger, work shops, garages and engine shed. Not bad for 70 years of hard work by the Lefroy family???? The negotiations mentioned by the Department of Lands [DoL] is NOT ongoing as per the email from the Minister for Lands sent Easter eve, we either accept their unacceptable conditions or lose the entire lease. 16.01.2022 NINGALOO STATION First and foremost a very sincere "Thank You" to all the supporters of our recent email campaign, and in particular, those of you who wrote to the government voicing your opposition to their proposed land grab of Ningaloo Station. The effect of your letters of support has been felt within government from the Premier down.... As previously advised, the Western Australian Government has announced its intention to NOT honour their written promise of 2005 and NOT renew the Ningaloo pastoral lease on the same terms of the existing lease on its expiry at 30th June 2015. Reluctantly we have been forced to seek legal advice to fight to save Ningaloo Station and its "Wilderness camping". We have received advise and encouragement from our Queens Council who is of the opinion we have two valid arguable cases to take to the Supreme Court. We have received a lots of messages from you asking what you can now do to help and due to the legal process at this level being a very expensive one, your support with the following would be very much appreciated. Hi Every one, If by error you have already received this email please accept my apologies in a...dvance You may have read in the West Australian paper [dated Saturday March 7 and Monday March 9 ] the Liberal/National government has had unrelenting pressure applied to them from the Department of Parks and Wildlife, formally Conservation and Land Management [CALM], formally Department of Environment and Conservation [DEC] to completely take over Ningaloo station and all of the "Wilderness camping" areas, all in the name of "Conservation". Minister Redman has said the Ningaloo coast regional strategy Carnarvon to Exmouth will be implemented and 100 bed Eco Lodges will be let to the highest bidder for Winderabandi Point, a 500 bed tourist node including accommodation, eco lodges, caravan parks food,grocery and fuel out lets at Ningaloo homestead, four camping sites with commercial eco camp style accommodation all situated on the firm flats at both North and South Lefroy bays and Janes bay will become day use only. In essence DPaW has again raised its ugly head and is relentlessly pushing government to resume ALL OF NINGALOO STATION for development to the highest bidder. Shops, fuel out lets, Eco tents and closed areas with draconian conditions/and limitations will be applied to Ningaloo station unless the tide can be changed. We ask if each and every individual person you know who has an affiliation or love of "Wilderness camping" on the Ningaloo coast email and ring the following to express their disapproval of the Department of Parks and Wildlife [DPaW] wanting the Ningaloo coast for development. You the campers and the pastoral station confronted DPaW attempting to take control of camping on Ningaloo station, we won that fight. As you are aware we have taken the Department of Parks and Wildlife to the Supreme Court to stop them taking our entire Ningaloo station from three generations of the Lefroy family for the purpose of development along the Ningaloo coast line. This development of the Ningaloo coastline, as outlined in the government document called "Ningaloo coast regional strategy. Carnarvon to Exmouth is the only reason for confiscating our entire 49,750 hec pastoral lease and our developing tourism business, and it will be sold, by DPaW, to the highest bidder. If this "Land grab" is permitted it will be the demise of "Wilderness camping" as we know it and love it. We have had positive discussions with the shadow Ministers for Lands, Major Peter Tinley, AM, and the shadow Minister for Tourism, Mr Paul Papalia to have the "Land grab" by DPaW reversed and the pastoralist to be permitted to continue with our lawful tourism business ["Wilderness camping"] and we are asking you and the many thousands of Ningaloo stations supporters to email both shadow Ministers and request them to put in writing to Ningaloo station their support so we the voting public may support them at the up coming election next March. 12.01.2022 To all of the past, present and future supporters of Ningaloo Station I draw your attention to the latest "survey" being conducted by the Department of Parks and Wildlife found on http://www.surveymonkey.com/r/W6K9WQL This survey only covers part truths and solicits answers they require, e.g. "Coastal camping will continue" yes it will but NOT near the beach as DPAW failed to advise you for example camping at Winderabandi point will be on the EAST side of the Yardi road thus ...requiring you to drive from the camping area to the beach. Camping prices will increase by 25% at Ningaloo station and all camping will be confined to sterile gravel pits. These are just some of the truths and once you see the survey you will note you need to advise DPAW of your education achievements and your full name and address ???. You can draw a conclusion on why they require this but fail to answer it and your survey wont be accepted. We are asking you to delay completing the survey or if you have completed one wait for a survey we will distribute asking the hard hitting questions and the truth of the matters. For example no questions have been asked on who you would prefer to manage the pastoral camping, are you contented to camp in a sterile gravel area lined with pole logs ? Phil would like to thank you for all your on-going support and to let you all know that the offer that was put to him was unreasonable and so the fight continues to Save Ningaloo Station. At this stage its looking like its going to be a long and expensive fight with the courts. More details will be released very soon.

I came across this page from another FB page ( it happens ;-) ) and I will ask the same question here as I asked that poster , i.e. - ""This is relevant , the current leaseholder should have further info to shed on this - "The Minister may refuse to renew a lease, renew it subject to further or different conditions; or renew the lease over only part of the lease area. In the case of a renewal application, the Ministers decision must be communicated to the leaseholder at least 8 years before the lease expires, and the leaseholder has one year to accept an offer of renewal." Has the leaseholder had 8 years notice ?? The above is from -http://www.edowa.org.au/.../ld_pastoral_land_management.pdf "" So , the question is , what is that history of communication on that between the parties , factually ? RESPONSE Hi Gordon, We have attempted to negotiate with the Department of Parks and Wildlife [DPaW] for 13 years but to no avail. The reason is simple we stood to loose 48% of our 50,000 hec lease, i.e. 22,202 hec of land which contained our 100 year old heritage listed homestead, shearers quarters, shearing shed, air strip, workshops, engine sheds, garages, three staff quarters and the list continues BUT the excised area also contained ALL of the stock watering points, holding paddocks, lane ways, tanks and troughs plus our privately owned and licensed six "Wilderness camping " areas We were left with 52% of nothing, no means of income, no building to support pastoralism, no stock watering points, no lane ways or holding paddocks, no homestead and water supply, no buildings. We attempted to negotiate the boundary so we could continue with the viable private business of pastoralism and tourism but it was rejected out of hand. We were offered the ultimatum to surrender the 48% of the pastoral lease or loose the entire lease !!! In relation to the renewal of the Ningaloo pastoral lease, the Hon Doug Shave, the then Minister for Lands renewed our lease [ in 1995] for 49 years plus 49 years, as of July 1,2015, with a condition that the government could excise any portion of land for "Public purposes". All of Western Australian pastoralist agreed with this condition believing it to mean if the government wish to install a public road, a harbour etc,etc we would accept it NO one believed a Government Department could take a viable tourist and pastoral business from people who have been here for over 70 years all in the name of conservation ????? 02.01.2022 To all the supporter of Ningaloo Station. To retain Ningaloo station in the hands of the Lefroys, as a pastoral lease and a "Wilderness camping area" we commenced Supreme court action against the Department of Parks and Wildlife (DPaW) in February, 2016 and are currently in mediation with them again. We oppose selling off another part of Western Australia to developers and relegating average Australians to the back blocks. Our life work covering three generations of the same... family, the investment into a viable pastoral station and tourism business seems to be of no concern to the DPaW. The next mediation session will be held on June 9th in Perth at the Supreme court. In the mean time with have had fruitful discussions with the shadow Minister for Lands, Major Peter Tinley [AM] and the shadow Minister for Tourism Paul Papalia and are hopeful to obtain an undertaking from them to reverse the compulsory acquisition of Ningaloo station by DPaW. Thank-you for your patience and as soon as we are able to advise you of any progress on either the Supreme court action or any undertakings by the shadow members of parliament, we will.
