15.01.2022 Yesterdays High Court decision ruled that a sperm donor, who had full intention to be apart of the childs life when donating, is the legal father. Unlike the situation where a sperm donor has no involvement or relationship with the child, the sperm donor in this case had a relationship with the child and donated on the intention that he would be part of the childs life. It was consequently held that he is the legal father of the child and should therefore be consulted with when making significant decisions in relation to the well being of the child. 14.01.2022 Over the last decade an increasing number of Australians are living in de facto relationships, while marriage rates have fallen. Reflecting this societal change, the law was changed in 2009 (2002 in Western Australia) so that the same law now applies to separating de facto couples as applies to separating married couples. That is, any financial dispute arising from the breakdown of a de facto relationship is decided by the Family Court and the Family Law Act (the Family Court Act in WA), rather than State law and the States’ Courts.
