23.01.2022 The Department has flagged concessions to a number of family stream visas to commence in early 2021, allowing offshore visas to be granted while the visa applicant is onshore. This will be a temporary concession for people who are in Australia and are not able to travel offshore to be granted the visa due to COVID-19 related border closures. No legislation has been passed yet, but it is expected that these concessions will apply to certain applicants for Child (subclass 101), Adoption (subclass 102), Dependent Child (subclass 445), Prospective Marriage (subclass 300) and Partner (subclass 309) visas. #immigrationlawyer #immigrationlaw #covid19 #nomoslegal

Seventy-four people have already been granted a French passport and another 693 are in the final stages. A total of 2,890 people have applied so far. 23.01.2022 BREAKING NEWS - Australia is offering extended visas to Hong Kong residents in Australia who feel threatened by new national security laws imposed by China. Under Australias new visa scheme 8200 students, 570 temporary skilled migrants, 900 graduate visa holders already in Australia will all have their visas extended by five years and become eligible for permanent residency. Hong Kong residents who already have a visa but are outside the country, including 2300 students, will also be eligible for the extension. #immigrationlawyer #permanentresidence #nomoslegal
23.01.2022 Further details on the Australian travel ban that takes effect from 9.00pm tonight: - there is no indication of how long this will remain in place - the following groups are exempt from the ban: Australian citizens ... Australian permanent residents New Zealand citizens who are usually resident in Australia spouses, de facto partners, dependants and legal guardians of Australian citizens and permanent residents. Note that there is a specific form to complete for temporary visa holders seeking to rely on these provisions to facilitate entry to Australia - do not travel until the Department has advised you that you can. All other temporary visa holders will not be able to enter Australia after 9.00pm tonight, 20 March 2020. If you hold a temporary visa and are in Australia, our advice is to stay put do not leave Australia and keep your visa expiry date in mind. Regardless of the current situation, you are expected to maintain your lawful status whilst in Australia. If you are an Australian citizen or permanent resident who has not yet returned home but wants to, we suggest you move quickly. It is becoming increasingly difficult to organise international flights. Some clients have reported that overseas airports are closing and crossing borders by land is becoming more difficult. 19.01.2022 INTERNATIONAL STUDENTS: Last week, the government outlined 5 visa changes for international students, intended to ensure international students are not worse off due to COVID-19. The changes include: - recommencing processing of offshore student visa applications so that when our borders re-open, students will already have visas and be able to make arrangements to travel; - allowing international students to lodge a further student visa application free of charge, if they ar...e unable to complete their studies within their original visa validity due to COVID-19; - allowing current student visa holders studying online outside Australia due to COVID-19 to use that study to count towards the Australian study requirement for a post-study work visa; - allowing graduates who held a student visa to apply for a post-study work visa outside Australia if they are unable to return due to COVID-19; - giving applicants additional time to provide English language results where COVID-19 has disrupted access to these services. The legislative instrument that confirms that COVID-19 affected students will be able to lodge another Student visa application free of charge has now been released. This specifies that no visa application charge is payable for a Student visa holder who held their visa on or after 1 February 2020 and is seeking to apply for a further Student visa to complete their study, if they were unable to complete their course within the validity period of their original visa due to COVID-19. #internationalstudents #Covid19 #nomoslegal
19.01.2022 DFAT has advised all Australians not to travel overseas, and if abroad, to return home as soon as possible. As more countries close their borders, the availability of commercial flights is rapidly decreasing. DFAT has also warned that consular assistance could be limited due to movement restrictions during the pandemic. In the UK, foreign workers have access to the equivalent of the JobKeeper scheme, and Canada and New Zealand have also provided some payments for some workers. States have provided some help, with one-off payments and rent relief to international students in Victoria, and emergency housing in New South Wales. Foreign work...ers in Victoria can also get the new $1,500 pandemic leave payment if they have to leave work because of COVID or are waiting for a test, and dont have any sick pay or annual leave. 13.01.2022 "The ABF approved 22,640 individuals to leave the country out of 91,950 requests overall, between March 25 to July 31. A request can cover more than one person. By August 16 that climbed to approval for 34,379 Australians to travel overseas out of 104,785 requests. That means the approval rate rose from 25 per cent to 33 per cent as a result of 11,739 additional exemptions but only 12,835 additional requests. Meanwhile, the ABF had also declined 7120 requests by the end of Ju...ly, 7.7 per cent of applications received to that date. These changes are designed to place a greater focus on Australian values. In his media release, Minister Tudge has stated that "more meaningful" questions will be introduced to the test so as to ensure new citizens understand and are willing to commit to Australian values including freedom of speech, mutual respect, equality of oppor...tunity, the importance of democracy and the rule of law. Five of the twenty questions on the test will focus specifically on Australian values, and all of these five questions must be answered correctly to pass the test. The TLR Foundation’s primary mission is to support the care and well-being of individuals with blood cancers, bone marrow disorders and other diseases treatable by a bone marrow or stem cell transplant. All donations in support of th...ose brave enough to Shave it Off on 7 April 2019 will go directly to funding a scholarship for nurses wanting to study a Master in Cancer & Haematology Nursing at the University of Sydney. We think this is a very worthwhile cause, so in addition to being a corporate sponsor of the Foundation, both Nomos Directors will take a seat at the shaving table on 7 April, and will emerge bald! 05.01.2022 A chef in the ACT has won a case against her former employer, with the ACT Civil and Administrative Tribunal finding that she was discriminated against due to her temporary visa holder status. You will need a valid visa to enter Australia, but you do not need to be a NZ citizen to travel to Australia quarantine-free.
