19.01.2022 EMPLOYEE STAND DOWN PROVISIONS under terms of Fair Work Act Standing down is an option as against redundancy (a last resort), and if after consultation with employees a change in the employment arrangements is not possible or agreeable between employer and employee (for example, unpaid leave). It is important to first look at the business planning of the employer for the next 1, 3 to 6 months and its budgets.... Section 524 is intended to relieve an employer of the obligation to pay wages to employees who cannot be usefully employed in certain limited circumstances. The consequences of a stand down can be severe for an employee as the employee may be deprived of wages for a lengthy period. 13.01.2022 What an emotional and meaningful day for Oceania Legal spent at the Australian Federal Parliament in Canberra yesterday discussing the culture and formation of Australian politics. We fulfilled a long time wish to watch the Questioning time at the Green Room House of Representatives (pictures not allowed there) where they were discussing recent cyber attack to all political parties emails, the Prime Minister actions to address and protect Australia against such threats; and ...the sad recent floods catastrophe outcomes in Townsville, the real estate legal battles that have taken place and a request from government to Insurance companies exercise mercy and leniency to the population who lost everything in the floods (the region is still under water). Awe, magic, duty and respect was what I felt entering that room for the first time. Also, a great honor visiting and lunching at the beautiful residence of the Brazilian Ambassador His Exc Sergio M Lima and his wife Madam Ana Lima alongside Ambassadors for Chile, East Timor and Costa Rica, ending the day with important discussions at the Brazilian Embassy building. We can say we were strangely emotional to enter the Australian political capital Canberra for the first time and will definitely come back for more soon. Congratulations the Agriculture Ministry and Department of Foreign Affairs Itamaraty for signing the free trade agreement between European Union and Mercosur (Brazil, Argentina, Paraguay and Uruguay) after 20 years of negotiations! The EU is already Mercosurs biggest trade and investment partner and its second-largest partner for trade in goods.... In terms of tariff reduction, this could be the EUs most lucrative trade deal to date, with the savings potentially four times greater than for deals with Canada and Japan combined. For Brazil, the agreement eliminates import tariffs for several farm products - including orange juice, instant coffee and fruit - and give greater access through quotas for meat, sugar and ethanol, boosting the economy and increasing investment in the country for the next 15 years. 03.01.2022 ESSENTIAL UPDATE - Mandatory industry code for commercial and retail leases revealed. The Code imposes a set of good faith leasing principles for application to commercial tenancies (including retail, office and industrial) between owners/operators/other landlords and tenants, in circumstances where the tenant is a small-medium sized business (annual turnover of up to $50 million) and is an eligible business for the purpose of the Commonwealth Governments JobKeeper programme.... Some of the directives: 1. Landlords must not terminate leases due to non-payment of rent during the COVID-19 pandemic period (or reasonable subsequent recovery period). 2. Tenants must remain committed to the terms of their lease, subject to any amendments to their rental agreement negotiated under this Code. Material failure to abide by substantive terms of their lease will forfeit any protections provided to the tenant under this Code. 3. Landlords must offer tenants proportionate reductions in rent payable in the form of waivers and deferrals (as outlined under definitions, below) of up to 100% of the amount ordinarily payable, on a case-by-case basis, based on the reduction in the tenants trade during the COVID-19 pandemic period and a subsequent reasonable recovery period. 4. Rental waivers must constitute no less than 50% of the total reduction in rent payable under principle #3 above over the COVID-19 pandemic period and should constitute a greater proportion of the total reduction in rent payable in cases where failure to do so would compromise the tenants capacity to fulfil their ongoing obligations under the lease agreement. Regard must also be had to the Landlords financial ability to provide such additional waivers. Tenants may waive the requirement for a 50% minimum waiver by agreement. 5. Payment of rental deferrals by the tenant must be amortised over the balance of the lease term and for a period of no less than 24 months, whichever is the greater, unless otherwise agreed by the parties. 6. Any reduction in statutory charges (e.g. land tax, council rates) or insurance will be passed on to the tenant in the appropriate proportion applicable under the terms of the lease. https://www.pm.gov.au//national-cabinet-mandatory-code-ofc
01.01.2022 ESSENTIAL NOTE ON BUSINESS SHUTDOWNS As we all all know, cafes, bars, restaurants and public places have been affected by the shutdown under Federal and State Laws. However, it is very important NOT to overreact and do more than is required under the law.... Shopping centres and retail stores in NSW ARE ALLOWED to trade as long as they keep up with the rule number 1 of social distancing. There is no need for special licences at this stage.. The only businesses that are obliged to stop operating as at todays date are those listed as not essential services (although such terminology will soon be modified). Hence, in line with health advice, from midday today, the following non-essential activities and businesses should be temporarily shut down: - Pubs, registered clubs - Gyms, indoor sporting venues - Cinemas, entertainment venues, casinos, and night clubs - Restaurants and cafes will be restricted to takeaway and/or home delivery - Religious gatherings, places of worship (excluding small weddings and funerals that comply with the 4m2 rule, which can proceed). Essential gatherings at places such as hospitals, workplaces, constructions sites and for public transport are exempt and will continue. Also further, personally, we do not partake in the approach of delaying payment of suppliers and invoices unless strictly necessary and objective cash flow issues start to appear. Be mindful of others. We understand these are times of distress to some businesses but it will pass. Please stay calm, seek proper advice, follow public health guidance and consider all your options before taking action. We are here for our clients and anyone who needs advice. Stay safe!
