25.01.2022 $45 million International Student Emergency Relief Fund. Australia Relief payment of up to $1,100: International students will receive a relief payment of up to $1,100 as part of a Victorian Government emergency support package that will help tens of thousands of people across our state. International students are a vital part of our education system, economy and community. They give so much to Victoria not just through the fees they pay, but also through the eco...nomic activity they generate for our businesses, and the contribution they make to our vibrant, inclusive society. COVID 19 Pandemic: Like so many people during this pandemic, international students have been affected by casual job losses in retail and hospitality, making it even tougher for them to make ends meet. Many have also fallen through the cracks of Federal Government programs unable to access the support they need to support themselves. International Student Emergency Relief Fund: To ensure Victorias international students can buy the basics and get through to the other side of the crisis, the Victorian Government will establish a $45 million International Student Emergency Relief Fund. The fund will provide a one-off payment to students in need while expanding emergency provisions for those experiencing exceptional circumstances. Who Could Benefit: Up to 40,000 international students enrolled at Victorian universities, TAFEs, private vocational education and training providers and English language colleges who have lost wages and work due to the coronavirus pandemic could benefit from the relief payment, which covers demonstrated lost income up to $1,100. The payments, which will require co-contributions from university hardship funds, build on existing Victorian Government support provided to international students through the Study Melbourne Student Centre such as free legal aid and mental health services. Victorian Governments rent relief program: More than 150,000 international students currently living in Victoria are also eligible for the Victorian Governments rent relief program, including subsidies of up to $2,000, and those legally allowed to work in Victoria are eligible for the Working for Victoria initiative, which helps people who have lost their jobs to find new employment. International education generated $12.6 billion revenue for Victoria last financial year, supporting around 79,000 jobs, with most students coming from China, India, Nepal, Malaysia and Vietnam.

15.01.2022 Sometimes an issue in migration law may seem head-spinningly technical, complex, and difficult to get your head around. And yet, these seemingly obscure issues may have hugely important consequences! This was illustrated by two recent companion decisions of Judge Smith of the Federal Circuit Court ... The question of whether the applicants were unauthorized maritime arrivals turned on whether the waters surrounding Ashmore and Cartier Islands are within the migration zone of Australia, as defined by the Migration Act. It will be recalled that the migration zone is defined to mean the area consisting of the States, Territories, Australian resource installations and Australian sea installations but does not include sea within the limits of a State or Territory but not in a port. the key point of latest decisions by FCC is that persons whose boats were intercepted in the waters of Ashmore and Cartier Islands and then transported from there to Darwin or elsewhere on mainland Australia are not unauthorized maritime arrivals and the Immigration Assessment Authority does not have jurisdiction to hear their case. So, if you are personally one of these boat arrivals, or one of your clients is, then your case is not subject to review by the Immigration Assessment Authority. If you or one of your clients falls within this cohort, it is essential to seek legal advice on an urgent basis!!!!!!

15.01.2022 Suppose you have a client who is seeking a further student visa to remain in Australia to pursue further studies. Suppose also that the student visa application has been refused by the Department, and the Tribunal has affirmed the refusal of the visa application on the basis that the Tribunal is not satisfied that the applicant intends genuinely to stay in Australia. Does that outcome necessarily mean that all hope is lost for the applicant, that the case is over, and that ...Continue reading

14.01.2022 The record number of international students sticking around on visas with full work rights More international students than ever are remaining in Australia for up to four years on graduate work visas following their studies. Labor's immigration spokesman, Shayne Neumann, said international students are an important contributor to the economy, but rapid growth in a visa subclass could be cause for concern.... "It's incumbent on the Turnbull Government to ensure the integrity of Australia's migration program," he said. Last year 350,000 international students were enrolled in universities an increase of 100,000 in the preceding three years. international students are allowed to work for 20 hours per week during semester under their visa, but no time or occupation restrictions apply to the "post-study" graduate visa stream. This provides a visa of two years following study or up to four years for some higher qualifications to those who complete degrees of at least two years. The visa may assist some towards a pathway to permanent residency, but the majority of international students return to their home countries.
