20.01.2022 As many of you may recall, the Department had been scheduled to update the Commonwealth occupation lists in March 2020. Before the occupation lists are updated, the Department of Education, Skills and Employment undertakes consultations with various stakeholders to ensure that the occupation lists will continue meet Australia’s short and medium/long term needs for the economy. The updating of the occupation lists, which was supposed to occur in March 2020, w...as put on hold due to COVID19. The second wave of COVID infections in Victoria has put the Australian labour market in a state of flux. The Department has decided to wait for things to settle on the job market before they update the occupation lists. At this stage, it is expected that the Commonwealth occupation lists will be updated in March 2021. We will provide a further update about any proposed changes to the Commonwealth occupation lists once the information becomes available. In the meantime, if you are holding a temporary visa which will be expiring, and intend to remain in Australia, please ensure you arrange a new visa as per usual. The Department has made clear that they do not want visa holders becoming unlawful in Australia, so please ensure you maintain a valid visa. If you wish to book a consultation to obtain advice about your visa options in Australia, please contact us at [email protected]
20.01.2022 - & Further to our previous post, it is expected that the new English language requirement for partner visa applications will be introduced in November 2021. Once the changes are introduced, it will apply to new applications received from the date of commencement. To re-cap, the English requirement will not be required for the 1st stage temporary partner visa and instead will be required when the Department assesses the 2nd sta...ge permanent partner visa. Applicants and their Permanent Resident sponsors will need to demonstrate they have functional English or have made reasonable efforts to achieve functional English such as completing 500 hours of the Adult Migration English Program (AMEP). It is also expected that the changes to the sponsorship process will be implemented at the same time. Once the changes take effect, the sponsorship application must be approved before the applicant can lodge the partner visa application. We will provide a further update on this once the information becomes available. As the partner visa has onerous eligibility criteria and the Department fee is extremely expensive, it is best to plan in advance. If you are considering a partner visa application and wish to book a consultation to have your eligibility assessed, please contact us at [email protected] See more
19.01.2022 - The Australian Government has announced that there will be new requirements for partner visa applicants and Permanent Resident sponsors to have functional English or to demonstrate they have made reasonable efforts to learn English e.g through the completion of 500 hours of free English classes through the Adult Migration English Program (AMEP). Acting Minister for Immigration Alan Tudge has indicated that it is expected t...hat these changes will come into effect in late-2021. This requirement be applied to the temporary partner visa, but the requirement will need to be met for grant of the permanent partner visa. The Australian Government has also indicated that during the 2020-21 program year, onshore partner visa applications and partner visa applications will be prioritised where the sponsor resides in a designated regional area. We will provide a further update in due course.
17.01.2022 () The Acting Immigration Minister Alan Tudge recently introduced the Immigration Education Amendment: Expanding Access to English Tuition Bill into the Lower House. This Bill has been designed to support the changes to the partner visa requirements for sponsors and visa applicants. Currently, the AMEP provides up to 510 hours of English language tuition to assist eligible migrants to learn English to help them to settle into ...the Australian community. If the Bill is passed, it will remove the current cap of free English tuition of 510 hours and provide unlimited hours of English tuition. The current exit point for participants in the AMEP is functional English (IELTS 4.5 or equivalent). This will change and will enable participants to continue to improve their English until they reach the point of vocational English (IELTS5.5 or equivalent). Lastly, the Bill will also remove time limits for participants to enrol, commence and complete their AMEP tuition. In a nutshell, these changes will mean that more migrants can access free English tuition for longer until they reach a higher level of English. It will also enable AMEP students to study English at a pace that suits their individual circumstances, and their family and work commitments. We will provide a further update in due course.
17.01.2022 For many visas, applicants will need to provide evidence of their English proficiency. For applicants who need to sit an English exam, the current accepted English tests are IELTS, TOEFL iBT, PTE Academic, OET and Cambridge C1 Advanced test. During the COVID19 pandemic, English testing was either suspended or limited in many test centres for a period. Some English test providers have been offering an English test which applicants can take at home such as TOEFL ...iBT- Special Home Edition, OET@Home and IELTS Indicator. Please note for immigration purposes, the Department does not accept any tests which can be undertaken at home, so please ensure you are undertaking an exam in person with one of the 5 prescribed English language test providers.

07.01.2022 - During Victoria’s lockdown, English testing was unavailable which has resulted in significant demand for English language testing. PTE Academic English tests will re-commence in Melbourne on 2 November 2020. PTE will open additional test centres in the Melbourne CBD to help meet some of this demand. Test centres are operating at limited capacity as there are restrictions on the numbers of test takers in each session. Test centres will be operating in strict accordance with local Government requirements. 05.01.2022 485 VISA Many international students dream of staying in Australia after they have completed their studies. Students studying in Australia may have a relevant qualification for their nominated occupation upon completing their studies, but they are often missing the work experience that is required to be sponsored by an employer, or they may not have enough points for a skilled independent visa. In this situation, the 485 visa can be an ideal solution for applicants who meet t...he visa requirements under the Graduate work stream or the Post-study stream. The 485 visa provides visa holders with time to gain full-time Australian employment experience, develop their professional networks and for visa holders from a non-English speaking background, it also provides time to improve their English language skills. The 485 visa can be utilised to improve points for a points-tested visa or to accrue work experience towards an employer-sponsored visa such as the TSS visa. The 485 visa is often crucial to an individual’s visa strategy because it is the visa that can open up an applicant’s pathways to permanent residency. For this reason, it is important to use the time on a 485 visa wisely and to obtain advice in advance, so that you know what your potential pathways to PR are, what the visa requirements are, and the steps you will need to take to maximise your pathways to PR. If you wish to book a consultation to obtain advice on your pathways to PR, then please contact us at [email protected] See more
05.01.2022 - Australian citizens and some Australian Permanent Residents in limited cases who are stuck offshore, unable to return to Australia due to COVID19 restrictions and in financial distress may be able to request financial support from the Australian Government. The support will come in the form of loans and grants in order to help cover living costs and/or a flight back to Australia.
