03.01.2022 Virgin Australia accept Enforceable Undertaking. What is an enforceable undertaking? When an organisation is alleged to have breached the Work Health and Safety Act 2011 (WHS Act 2011) they can propose an enforceable undertaking as an alternative to a prosecution. WorkSafe ACT (and other state WHS compliance organisations) is not compelled to accept an undertaking and perform an evaluation of all proposals put forward.... If accepted, the enforceable undertaking is a high level sanction that is legally binding, if the contravention is of a serious nature. An alternative to court, an enforceable undertaking gives the organisation an opportunity to implement effective WHS as part of their reform. This is the first time Worksafe ACT has accepted an enforceable undertaking under the WHS Act 2011 The Virgin Australia case On 23 May 2013 an employee of Virgin Tec Pty Ltd (a division of Virgin Australia Group) was walking from the tarmac area to the maintenance office at Canberra Airport when a 'high speed door' closed, striking the worker to the head and neck. The employee was paid $20k in benefits and returned to work at the end of June 2013. The enforceable undertaking WorkSafe ACT has accepted the enforceable undertaking of $625,000 for Virgin Australia Group, which includes the following requirements: $270K | Implementation of a new injury management/early intervention program. $85K | Employment of a WHS specialist for regional port management. $50K | A donation to Neurosurgical Unit, Canberra Hospital, ACT Health. $50K | Implementation of an assurance and compliance reporting platform to enable workers in all locations to report safety incidents, complete inspections and inductions to identify WHS hazards and manage WHS risks. $40K | Implementation of work health and safety (WHS) training programs for Virgin Engineers. $30K | Performance of annual external audits of the Virgin Australia Group WHSMS pursuant to the AS/NZS 4801:2001 Occupational Health and Safety Management Systems". $20K | Investment in the provision of training to enable workers to achieve a Certificate IV WHS in WHS (to be delivered by the Virgin Australia Group and its RTO Partner, Parasol). $20K | The development of post-graduate leadership programs to enable workers to achieve a Vocational Graduate Certificate in WHS. $20K | Sponsorship of an education program for community members in the ACT (to be selected by WorkSafe ACT) to enable community members to achieve a WHS qualification. $15K | Education and training of Virgin Australia Group Senior Managers in relation to their obligations under WHS legislation. $15K | The development of a leadership safety assessment process. $10K | Implementation of a workplace induction platform for workers commencing work at new work sites so they are aware of site specific hazards.
