07.01.2022 NEW CASE UPDATE The final hearings of the misleading and deceptive purple signs cases against Gladys Liu and Josh Frydenberg will be held in the Federal Court (sitting as the Court of Disputed Returns) in Melbourne, on 6 to 8 November. The Court will be deciding whether the Chinese language signs posted by the Liberal candidates at polling booths all over Chisholm and Kooyong on election day were misleading or deceptive (an offence under the Commonwealth Electoral Act) and wh...ether this made the election results in those seats unsafe so that they should be declared void and fresh by-elections held. The position of the Liberal Party in these cases is not easy to work out: they have admitted that the signs accurately translated as instructing voters that the correct way to vote was to put 1 next to the Liberal candidate, but they are claiming that that’s not what they intended the signs to say. Their defence seems to be that they stuffed up the translation! Seriously. The Liberals also admit that the signs were in AEC colours and had no Liberal party branding on them, contrary to the party’s own official guidelines for advertising material (which is all in Liberal blue and plastered with the party name and logo). Their own documents show that they intended the signs to look like AEC material. The main issue in dispute is who knew what and when. This is not just the Libs, but the AEC too. Frydenberg denies any knowledge of the signs at all. Liu says she doesn’t admit that she knew about them, but agrees it can be inferred that she saw them! What on earth that is supposed to mean, is anyone’s guess. As for the AEC, it knew about the signs from very early on election day, as the complaints started immediately and continued pouring in all day long. The AEC did nothing, and its only interest in the court case seems to be to defend its own inaction and failure to enforce the law. In the end, we think there’s a simple question here: is what the Liberals admit they did on election day in creating and posting these signs, okay? Is it okay for a major party to make up signs designed to look like official AEC directions, which explicitly tell voters that the only way to vote correctly is to vote for them? As we all know, following directions has cultural meaning in China and not following directions is a risky thing! It is intimidating and a cultural challenge to act against a direction. If that is acceptable behaviour, then what wouldn’t be? That is why we’re fighting this case. Our legal team is working flat out getting the case ready for the hearing on a very short timeframe. There’s no precedent to follow, so we’ll be making law whatever happens. The stakes couldn’t be higher. This is a stand for integrity.
