11.01.2022 I cant stress enough that if you reach a direct agreement between yourself and your partner as to property settlement or childrens issues, even though it may all be very amicable, your agreement is not legally binding or enforceable until you document it formally by lodging Application for Consent Order documents with the Family Court of Australia. 02.01.2022 Do not assume that because your former partner may have used marijuana while you were together, that in the event of a separation this means the Court will Order supervised time with the children based on that reason alone. I cannot count how many times I have heard a Judge say words along the line of " so it was OK that he/she smoked marijuana while they were together and was left alone with the children then, but now the children are all of a sudden at risk". This type of issue is complicated and is very fact specific. The use of drugs is not being down-played here, neither is it being condoned. The point is, get advice before you make your own case worse for yourself.
