25.01.2022 Contrary to popular belief, theres no 50/50 "starting point" for property settlements. There are numerous factors that are taken into consideration in order to arrive at a "just and equitable" outcome according to the law. Who brought what assets, liabilities, superannuation to the marriage? Who made what financial contributions during the marriage and post-separation? Did anyone receive any gifts or inheritances? What do your respective futures look like?

24.01.2022 So, youve agreed that one of you will split some of your superannuation to the other. What next? You will need to afford procedural fairness to the super fund, and obtain their confirmation that they have no objection to the split. Then youll need to include the necessary Orders in your Consent Orders (tip: funds generally require their own very specific wording). When you file your Consent Orders with the Court, youll also need to file an Affidavit, satisfying the Court... that the fund was given procedural fairness. Once your Consent Orders are filed and approved by the Court, the Orders will need to be served upon the fund, and certain other documentation completed. 21.01.2022 Wondering how the current lockdown will impact child access arrangements? This lockdown has significantly tougher restrictions than previous lockdowns we have experienced in Queensland. The effect of the current directive from Queensland Health is that if you do not have a Court Order, there is to be no movement between separated houses until lockdown is over. Even if you have a Parenting Plan, you cannot do a changeover until lockdown is over without Court Orders.... Please see below the advice directly from the Queensland Health Website. Q: I am meant to have custody of my child over the coming days, is this still allowed? A: For children under 18 who do not live in the same household as their parents or one of their parents they are allowed to leave home to continue existing arrangements for access to, and contact between, parents and children - as long as this is a court sanctioned parenting order and does not include contact with people who are vulnerable to COVID-19, for example someone aged over 70. Q: I have child custody arrangements in/out of the lockdown area, can I visit/travel with my child or to get my child?
