24.01.2022 Failure to Perform - One of the most common problems experienced by businesses during COVID-19 is failure by parties to perform obligations. If you are uncertain as to your rights, or unable to resolve a dispute, we can tell you where you stand and ‘bat’ on your behalf. This law can be complex: we may need to construe terms of a contract or apply common law; we may need to identify a remedy outside of contract law, such as ‘restitution’. 19.01.2022 Taking Stock - While 2020 hasn’t gone to plan and many businesses hibernate or operate at reduced capacity, the time is ripe to adapt and STAND OUT. The most valuable business assets can include key people and goodwill (often consisting mostly of intellectual property). It’s important to secure copyright and trade marks, and implement licence agreements. Some due diligence may be necessary. If you would like help, we offer affordable solutions. You can contact us by direct message, email or telephone on 07 4031 7133.

17.01.2022 Do you know that once your design is ‘published’ (made generally known to the public), it is not currently registerable (for protection) in Australia? However, a draft Bill currently in the consultation phase, intends to amend the Designs Act to assist designers in a number of ways including adding a ‘grace period’. If you would like help registering your design, contact us at [email protected] or 07 4031 7133.... 09.01.2022 AUSTRALIAN GOVERNMENT SECOND STIMULUS KEY MEASURES We are weathering the storm with our clients and the Cairns community through these turbulent times by providing as much helpful information as possible and rapidly adjusting to assist with practical and legal issues arising from this novel situation. Takeaways from the Government’s second stimulus package announced this morning:... Insolvency and bankruptcy laws relaxed for 6 months: minimum amount for creditor’s statutory demands and bankruptcy notices increased to $20,000 and time frames for responses extended to 6 months (from 21 days). Debtors declaring their intention to enter voluntary bankruptcy will be given an extension to the protection period (from 21 days to 6 months) during which unsecured creditors cannot take further action to recover debts. Directors will be relieved from personal liability for insolvent trading in the ordinary course of a company’s business for 6 months (criminal penalties still apply for dishonesty/fraud). Unsecured loans for SME’s of up to $250,000 over a 3 year period, with no repayments for 6 months and with lenders receiving a 6 month exemption from responsible lending obligations to hasten access to credit. SMEs and NFPs may receive payments of $20,000 to $100,000. The initial package has been enhanced to increase the wages withheld threshold to 100% with limits increased and additional payments introduced. Early access to super for individuals affected: $10,000 tax free this financial year and next financial year. Two $750 tax free payments to recipients of particular income support (they do not count as income). An additional $550 per fortnight for 6 months for recipients of particular income support, effectively doubling job seekers’ income support payments, with accelerated processing. For further information including eligibility requirements, see the link below and view the Fact Sheets therein. https://treasury.gov.au/coronavirus Should you require legal assistance, we are here to help: 07 4031 7133 / [email protected]. 03.01.2022 How we are managing COVID-19... O’Reilly Stevens Lawyers is committed to maintaining a quality legal service to all our valued clients during the COVID-19 outbreak, as well as maintaining a safe and healthy environment for our staff members and clients who do need to attend at our office. Our criminal and family law services will operate in accordance with the relevant court guidelines which have been issued in response to the situation. Those guidelines are centred around d...ealing with urgent matters in certain circumstances. Most new and existing non-urgent matters will be adjourned for approximately 3 months. Procedures have been implemented to minimise personal court appearances. We will continue to offer representation and advice as matters move through the criminal justice process, albeit on a much slower time frame than previously enjoyed. Our property conveyancing services are still operating and in some cases can be completed electronically on the PEXA platform, thereby eliminating altogether any need for person to person contact in the settlement process. Our business, commercial and intellectual property services continue without disruption. In most cases, client meetings can be facilitated by teleconference or video conference. Similarly with Wills and estate matters, we can take your instructions and prepare documents with minimum need for face to face contact. We have implemented hygiene practices in accordance with the current government recommendations. Frequent contact surfaces such as counter tops, conference rooms and door handles are wiped with disinfectant several times during each day and after each meeting. Antibacterial hand sanitiser is available for use throughout the office. The well-being of our staff is paramount, with many of our solicitors having the ability to work from home should they become unwell or need to self-isolate. Our teams have sufficient depth of numbers and experience that operations can continue even if a number of our staff should fall ill and be unable to work at the same time. If you believe you require a face to face meeting with any of our staff, we ask that you first telephone our office. We will ascertain whether we can deal with your concern by a means other than a physical attendance upon our office. Should a physical attendance be unavoidable, we will first ask you to confirm that you have not returned or arrived from overseas in the last 14 days, and that you are not currently experiencing any cold or flu like symptoms. Be assured that at O’Reilly Stevens Lawyers will continue to offer quality legal advice in this time of uncertainty. Real People, Real Solutions.
