Here's how: (1) Set up Google Alerts to monitor the web for mentions of your business. (2) Respond to both positive and negative comments and reviews asap. (3) If it's genuine, take the conversation out of the public eye, eg. offer to email and r...esolve the problem directly. (4) If it's not genuine, eg. defamatory or misleading, take legal action such as sending a Concerns Notice or Takedown Notice to the author and/ or host site. 12.01.2022 Watch out for scams! Today we received a scam letter to renew our business name. At first glance it looked a little bit legit except that it wasn’t. It wasn’t from ASIC. It wasn’t time to renew. And it referred to a non-ASIC website address which quoted the price as $99 per year (the real fee is $36 per year). If you get an email or invoice or phone call which feels wrong Take Two and do some research. Regulators will always correspond on official letterhead or from .gov email addresses, or through MyGov, and will allow reasonable notice periods for payments. Don’t get scammed.

07.01.2022 The Year That Was! 2018 saw the Australian Competition and Consumer Commission impose record penalties for breaches of the Australian Consumer Law which affected consumers and small businesses. The highest penalty imposed was $12 million against We Buy Houses Pty Ltd for false and misleading representations, specifically free seminars, ‘boot camps’ and mentoring about creating wealth through real estate. 06.01.2022 A win for potato farmers! The Federal Court has found contract terms between Australia’s largest potato wholesaler, Mitolo Group Pty Ltd, and potato growers to be unfair terms, and therefore void. The unfair terms provided for Mitolo to unilaterally vary terms, such as the price paid for potatoes, declare potatoes as wastage, and prevent growers from selling potatoes to alternative purchasers. As a result of the Court action which cost Mitolo nearly $300,000 in penalties an...d the ACCC's costs, Mitolo have undertaken to use a revised contract with terms that provide growers with: greater transparency and certainty over pricing; and the right to sell potatoes to alternative purchasers if offered a better price. Regulator action, such as this, to prevent the use of unfair terms is going to get tougher as the government is looking to introduce penalties for the use of unfair terms. See more

03.01.2022 Samsung has heavily promoted its Galaxy phones as water resistant, suitable for use in all types of water. Not so! According to the Australian Competition and Consumer Commission (ACCC) who filed court proceedings last week alleging that those representations are false or misleading with regards to performance characteristics, uses and benefits, characteristics and suitability. The ACCC is seeking penalties, consumer redress orders, injunctions, declarations, publication orde...rs, an order as to findings of fact, and costs. Samsung must prove they had a reasonable basis for making the representations, but even if they do, their time, resources and reputation are already impacted. 01.01.2022 Rugby Australia (RA) has terminated Folau's employee contract for breach of their social media policy. Rather than appeal this decision, Folau has commenced court proceedings against RA, alleging discrimination on the basis of religion. Whatever the outcome of these proceedings, this very public matter has four important lessons for employers and employees: (1) Employment contracts can include morals and/ or social media clauses which provide for disciplinary action such a...s termination if an employee's conduct brings the employer into disrepute. (2) Workplace policies and Codes of Conduct should reflect the employer’s values and expectations, as well as those of clients and stakeholders.
