The Family Court Chief Justice Will Alstergren presided over a case with two of his colleagues as to whether a judge and a barrister who met for drinks, coffee and exchanged multiple text messages while a case was on foot was grounds for ordering a retrial of a protracted family law dispute.

15.01.2022 Today we appeared before Magistrate Keady at Parramatta Local Court defending our client who was charged with one count of Common Assault (DV). The alleged facts were that our client a female has Assaulted her husband who recorded a video of his wife threatening to assault him. Police arrested our client and our client participated in electronic record of interview with suspected person (ERISP). Today we challenged both the ERISP & video recording and our submissions based on a recent High Court were accepted by the Court. Once these two pieces of evidence were thrown out of evidence, our client was found NOT GUILTY by the Court. 13.01.2022 Affray and violent public disorder law in New South Wales What is Affray? Affray is a common charge for violent public conduct that disturbs peace. Police often prefer to use this charge when they believe they are unable to prove an assault. Conduct such as violence, threats and anti-social behaviour can be included under this charge. These charges differ from assault, as they involve the element where a person of reasonable firmness (i.e. an innocent bystander/witness), wh...o is not a participant of the violence, being disturbed. This means the prosecution does not need to prove an innocent bystander was physically hurt as long as they would feel their personal safety is at risk, it is enough to prove a charge of affray. While traditionally the law has acknowledged that it is acceptable for a parent to use physical force on their children, the modern approach has denounced it. In 2002, the government of N...ew South Wales amended the Crimes Act 1900 (NSW) (‘the Act’) to include section 61AA. The introduction of this section brought clarity as to what is and what is not acceptable conduct to lawfully correct your children.
