23.01.2022 Queensland University of Technology (QUT) staff will this vote on pay-rise freezes, moratoriums on forced redundancies and temporarily halting the payment and accrual of leave loading, as the institution proposes a raft of changes to employee’s enterprise agreements in a cost-saving move. The university’s Vice-Chancellor and President Professor Margaret Sheil today outlined the proposed changes as part of the university’s response to the economic blow the coronavirus pandemic... had caused. Professor Margaret Sheil, new vice-chancellor at the Queensland University of Technology, announced the proposed changes today. It follows negotiations with the National Tertiary Education Union (NTEU) and the Together Union to propose a variation to the current Enterprise Agreements. Professor Sheil said the negotiations had been productive and were aimed at preserving as many jobs as possible. The proposal also includes changes to leave provisions, including COVID-19 leave, and the use of leave for Christmas shutdowns this year and in 2021, commitments for retraining, and maintenance of superannuation contributions. Staff will be able to vote on the proposed changes this month before the next stage of cost-saving measures, the realignment of faculties and schools begins. The university has already halted the majority of its building programs and consolidated administrative divisions from six to three. All of our senior staff have reduced their hours to a nine-day fortnight for the next 12 months, a move for which I am very grateful and one that marks the commitment of the 150 strong leadership team to QUT’s future, Professor Sheil said. The university is also proposing to move from two institutes and six faculties to five faculties such as Business and Law; Creative Industries, Education and Society; Engineering; Health and Biomedical Innovation; and science and Environment. Professor Sheil today told students they would still receive the same qualifications and education. The third stage of changes will then involve continuing the university’s digital transformation to ensure the virtual campus has the same offerings as it’s two physical campuses. This will enable more flexible learning and give access to high quality QUT courses to a greater number of students throughout Queensland and more broadly throughout Australia, Professor Sheil said.

Schedule X (which provides the entitlements) will continue to apply in these awards until a further order is issued by the Fair Work Commission.

10.01.2022 The Morrison Government has this morning introduced legislation to permit all parents to take up to 30 days of flexible unpaid parental leave until their child turns two and ensure 12 months of unpaid parental leave is available for families dealing with stillbirths, infant deaths and premature births. IR Minister Christian Porter told Parliament the Fair Work Amendment (Improving Unpaid Parental Leave for Parents of Stillborn Babies and Other Measures) Bill 2020 "could mean,... for example, a new parent spending a block of unpaid parental leave with their newborn after birth and then taking 30 days flexibly after they return to work". "Employees will be able to take these days as a single day, groups of days or a single continuous block." Porter told Parliament that the Bill improves support for employees who experience stillbirth or the death of a child in the first 24 months of life. "Under the current Fair Work Act, parents on birth-related unpaid parental leave who experience a stillbirth or the death of their child in the first 24 months of life can be recalled to work from their leave with just six weeks’ notice from their employer," Porter said in his second reading speech. "Parents on adoption-related unpaid parental leave whose child dies in the first 24 months of life can be recalled to work from their leave with just four weeks’ notice. "If these parents are not already on unpaid parental leave, the Fair Work Act allows an employer to cancel their upcoming leave in these circumstances. "While recognising most employers are supportive of their employees, particularly where they have suffered such a tragic loss, the Bill will ensure that the entitlement to unpaid parental leave for a parent whose baby is stillborn will be as it would have been if their baby had lived. " He said that for parents whose child dies during the first 24 months of life, the Bill "will ensure that their employer will no longer be able to cancel any upcoming unpaid parental leave they might have, or, if they are already on leave, require them to return to work earlier than they may wish to". Porter continued that under the changes, parents with babies that are hospitalised post-birth "will also have greater flexibility in deciding how they can use their unpaid parental leave".

09.01.2022 Employers that engage in deliberate wage theft face jail terms of up to a decade and 14 years when fraud is involved after the passage of legislation in Queensland's Parliament today, while employees under federal and state laws will have access to what the Palaszczuk Government promises will be a "simple, quick and low-cost" recovery process for underpayments. IR Minister Grace Grace said in her second reading speech in July that the legislation's amendments to the criminal ...code "reflect the seriousness of wage theft and signal Parliament’s intention to provide a deterrent to those employers who deliberately underpay and take advantage of their workers". She continued that the legislation would also provide an "accessible small claims process for wage recovery matters for all Queensland workers". She said the report of the inquiry into the legislation "found that wage theft is endemic across Queensland, affecting 437,000 workers and costing them approximately $1.22 billion in wages and $1.12 billion in unpaid superannuation each year". The report also "highlighted the bleak situation facing underpaid workers who must attempt to navigate the legal system to recover their wages, with approximately half of affected workers opting not to even pursue a claim". In the wake of the Bill's passage, the Queensland Council of Unions this afternoon renewed its call for "detailed public guidelines" that set out the criteria for police to investigate an alleged wage theft offence. It also wants a clear picture of the "gateway" or public interest test for a wage theft prosecution. The guidelines would also set out how the police might deal with wage theft complaints and the types of matters considered to be wage theft. QCU deputy secretary secretary Jacqueline King said the Queensland wage theft legislation differs from that of Victoria in that the southern state has an industrial inspectorate to investigate matters, whereas the sunshine state will be relying on police to investigate and for police prosecutors to launch prosecutions. She expects the Queensland Police Service would draft such guidelines with assistance from the State's Office of IR. King returned to the peak body as its deputy secretary in February this year, some 21 years after her last role as an industrial officer at the organisation. Meanwhile, Victoria's wage theft legislation takes effect in the middle of next year.

07.01.2022 The Fair Work Commission has announced a 1.75% increase to the National Minimum Wage (NMW) following its 2020 Annual Wage Review. The increase applies to awards in 3 stages, which start from the first full pay period on or after: 1 July 2020... 1 November 2020 1 February 2021. If you’re not sure which award applies, give us a call! For anyone not covered by an award or an enterprise agreement, the new national minimum wage will be $753.80 per week or $19.84 per hour. This applies from the first full pay period on or after 1 July 2020.
