Here is a summary of the legal position of surrogacy in Queensland and Australia:... The Surrogacy Act Qld 2010 regulates surrogacy arrangements in Queensland, including the transfer of parentage rights for a child born as a result of a surrogacy arrangement. In Queensland and anywhere in Australia, surrogacy arrangement is not enforceable. However, intended parents can recover expenses from a surrogate if the surrogate changes her mind and refuses to relinquish the child to the intended parents. This means if the Surrogate decides not to deliver the child after birth, you can legally demand a repayment of all your reasonable expenses towards to the surrogacy arrangement. Note also that Commercial Surrogacy is illegal in Australia and can lead to 3 years’ imprisonment. The Surrogacy Act Queensland in section 46 provides that a person must not enter into or offer to enter into a commercial surrogacy arrangement.
