22.01.2022 What if my Ex and I can’t agree on a value? Often when you separate, one of the things you and your ex are not able to reach agreement about is what value to place on your assets. This can include your home, investment properties, cars, business and even furniture and artwork in your home. So what happens when you can’t reach agreement on a valuation with your ex?... Appraisals Real estate appraisals are often free, quick and easy to obtain from your local real estate agent. Your real estate agent will compare sale prices of similar homes in the area and give you their opinion, generally in the form of a range of what your home may be sold for. While this is generally a good first step, sometimes a real estate agent may give you an overly optimistic value of your home. Bank Valuations There are occasions when bank valuations are notoriously lower than what a registered valuer may value your home at. While you and your ex can agree to using the latest bank valuation, it may be significantly lower than what your home would sell for to a willing purchaser. Joint Real Estate Valuations When you and your ex cannot reach agreement on the value of your home, the Court Rules provide that a joint valuer is to be appointed. This means that you both agree on the valuer and they attend at the property to inspect it and thereafter provide you with a formal valuation. Motor Vehicles Unsurprisingly, unless you are driving a luxury motor vehicle, your car is likely worth a lot less than you paid for it. We suggest that Redbook valuations be obtained online prior to any discussions about formally valuing your car. Businesses Generally, a forensic accountant is approached jointly by the parties to undertake a valuation of the business. Generally, in family law matter there are two valuation methods used, those being the net realisable asset value and the future maintainable earnings value. To undertake these valuations, numerous documents are required to be provided to the valuer covering a period of 3 to 4 years. Often the appointed valuer interviews or asks a series of questions of the business owner so that they can understand the business.
