13.01.2022 LANDLORD AND TENANT UPDATE - COVID -19 PLEASE SHARE Yesterday the QLD Government tabled a draft regulation for the Residential Tenancies and Rooming Accommodat...ion Act 2008 in response to the COVID-19 Pandemic. I have spent quite a bit of time today reading through the regulation this morning and have provided a bullet point summary for our clients below which I hope will provide further clarification for you. I would like to also thank all lessors who took the time to contact the Premier regarding the proposed reforms, it is clear that this feedback was heard and the new reforms are much fairer to all parties. Definition of ‘Financial Hardship’, Evictions & Dealing With Inability to Pay Rent A tenant has been deemed to be in financial distress if the total net income of the household has been reduced by 25%, or the rent now exceeds 30% of the net combined income of all occupants within the property. This net income is to include any Government Benefits they might be receiving. A moratorium on evictions for failure to pay rent is now in place and backdated to start as of the 29/3/2020 through to the 29/9/2020 or the last day of the COVID-19 emergency period. A lessor also cannot issue a Notice to Leave Without Grounds (e.g. at end of lease) if the tenant is known to be in hardship due to COVID-19. A lessor can still issue a Notice to Leave if they intend to sell the premises (evidence may be required), or if either the lessor or an immediate family member needs to move into the premises. Penalties apply for issuing a Notice to Leave under false pretences. Any leases which expire between now and 29/9/2020 must be renewed automatically through to 30/9/2020 if the tenant is suffering hardship due to COVID-19, unless the tenant requests an earlier lease end date. If a tenant has advised (or if we should reasonably know) that they are in financial distress due to COVID-19 we cannot issue a Notice to Remedy Breach on the 8th day as per usual arrears protocol. Instead a Cause Notice for Unpaid Rent must be issued, which asks the tenant to either a) pay the rent or b) provide evidence of their financial hardship within a 14 day period. At the end of the 14 day period if the tenant has not provided evidence or paid the rent than a breach for unpaid rent can be issued at that time. Lessors and tenants must enter into negotiations for rental deferments or rental reductions if the tenant advises they are in financial hardship due to COVID-19. An agreement for a deferment/reduction can be entered into at any time, it must be agreed to in writing and in the instance of a deferment there must be a written payment plan for the unpaid rent to be recovered at a later time. Any temporary reductions or deferments will not affect the bond monies being held (aka the legislation stating that the bond cannot exceed 4 weeks rent will not apply in this instance). If an agreement cannot be reached between the lessor and tenant then a dispute conciliation process must be entered into. If agreement can still not be made then the tenant can apply to QCAT for a termination due to financial hardship If a tenant wishes to end their lease early (often referred to as a ‘break lease’), then the costs normally charged to the tenant are capped at 1 week rent IF they have lost over 75% of their household income due to COVID-19 AND have less than $5000 savings. Tenants in financial hardship due to COVID-19 cannot be listed on Default Databases such as TICA for unpaid rent. Agents/Lessors can request evidence from tenants to prove their financial hardship and that the hardship has been directly caused by COVID-19. It is an offence under the Act to provide false or misleading information regarding their financial situation and they are also obligated to inform their agent/lessor if their financial circumstances change. Access to Properties & Maintenance During COVID-19 A tenant can refuse access to their property for routine repairs, inspections, valuations or for prospective/buyers or tenants to view the home if they are under a Quarantine Directive or if they advise that someone in the home is vulnerable. A tenant must allow virtual inspections and video conferencing wherever possible if they cannot provide access due to the above. Tenants must still provide access to the property for emergency repairs and smoke alarm & safety switch compliance. Tradespeople are to ensure they follow correct social distancing & safety protocols. Tenants cannot issue the lessor with a breach for routine repairs IF tradespeople or supplies are unavailable due to COVID 19. They can also not issue a breach if they are unable to provide access to the property due to Quarantine Directives or if someone in the home is vulnerable. The lessor must still attend to emergency repairs in accordance with the RTRA Act 2008. A tenant can issue a Notice to Leave within 7 days of starting a tenancy if the property is not in good repair or if it does not meet the prescribed minimum housing standards. I hope this information is helpful, if you have any queries whatsoever please don’t hesitate to reach out. The good news is that for those landlords that have properties that are vacant or due to come up for vacancy, don’t fret. Tenants that are looking to move are those whose lives are continuing on as normal and vetting of any application is being taken very seriously.
