25.01.2022 Do you have a paper certificate of title for your property? From 1 October 2019, a Certificate of Title for a property issued in Queensland will cease to have any legal effect. What do you need to know? ... The true record of ownership will be the electronic title held by the Titles Office; You can keep the Paper Certificate of Title for your record or destroy it; Dealings can be registered in relation to a property without the need to produce a certificate of title issued for the property; Any protection that the certificate of title provided to you against the registration of unauthorised dealings in relation to the property will no longer exist; If you become aware of any unauthorised dealing with the property, it is important that you contact us immediately so that we can action any necessary lodgements to protect your interests; Leaving a certificate of title with a person or entity will no longer give rise to an equitable mortgage pursuant to the Land Title Act 1994 (Qld). While this will not of itself invalidate an equitable mortgage that arose as a result of the provision of a certificate of title to a person prior to 1 October 2019, if a paper certificate of title for a property is held as security, you should consider if any steps are required to ensure your interests remain protected. 07.01.2022 Here are some details regarding the Job Keeper program:There are six (6) requirements in the Coronavirus Economic Response Package (Payments and Benefits) Rules 2020, five (5) of which are the responsibility of the employer: The employer must demonstrate that as at 1 March 2020 it carried on a business in Australia (s 6(1)(b) and 7(1)(a)); The employer must be satisfied it is not an excluded entity (s 7(2)); The employer must demonstrate that the employee has been paid ...at least $1500 per fortnight (s 6(1)(d) and s 10); The employer must demonstrate that it has suffered a turnover decline of at least 30% (50% for entities with aggregate turnover in excess of $1 billion and 15% for an ACNC-registered charity (s 7(1)(b) and s 8); The employer must notify its election to participate (s 6(1)(e) and give information about the eligible employees (s 6(1)(f) to the Commissioner before the end of the relevant fortnight and notify the individual in writing within seven (7) days; See more

05.01.2022 Be careful when accepting documents signed electronically. Note the recent Supreme Court decision Adelaide Bank Ltd v Pickard [2019] SASC where a deed was found invalid because the Board has not formally resolved to authorise signing by the Directors and in particular, to sign the document electronically. Make sure you obtain evidence of formal authority when accepting signed contracts and deeds. Ask us how.
