21.01.2022 What is the difference between a parenting plan and application for consent orders? If you and your partner have separated and you have been able to agree to arrangements for your children, including the time that you will both respectively spend with the children, their religion, schooling and extracurricular activities, these arrangements can be formalised by way of Consent Orders or a Parenting Plan. A Form 11 Application for Consent Orders is a document within which you s...et out your agreement in relation to your children. The Court must be satisfied that the Orders you are seeking are in the best interests of the children. Once approved by the Court, these Orders become binding and consequences can follow if the Orders are not complied with and are contravened. A Parenting Plan is an agreement which is written and signed between the parents. You and your former partner will not be required to file the document with any Court. The terms of the Plan are not enforceable as such, however, the Parenting Plan is considered by the Court should any litigation later proceed. 06.01.2022 What are some of the exceptions to attending compulsory mediation for children’s matters? The law requires that before you file an application for Parenting Orders in the Family Court, you and your former partner must attempt family dispute resolution. Following family dispute resolution, you may be issued with a document known as a Section 60i Certificate which allows you to commence a Court application. However, there are some exceptions to this law as follows: 1. The Cou...rt is satisfied that there are ‘reasonable grounds’ to believe that: a. Family violence or child abuse has occurred; or b. There is a risk that family violence or child abuse may occur; 2. Where a matter is urgent, for example, you do not know the whereabouts of your child; 3. Where your former partner has contravened an Order. If these exception apply you may be exempt from having to participating in mediation prior to commencing litigation before the Court for parenting Orders.
