25.01.2022 Superannuation - how to control what happens to your super when you die. Your superannuation death benefit entitlements can be significant. However, many people are not aware that their superannuation death benefit entitlements do not necessarily fall into their estate to be distributed in accordance with their Will. Superannuation is held within a trust and until such time as it is paid out of the trust to an individual, it is legally owned by the trustee.... How superannuation entitlements are dealt with upon a persons death largely depends on the terms of the trust establishing the superannuation fund and what nominations have been made by the person during their lifetime (and whether these nominations are binding or not). Below is an interesting article about the consequences of not nominating a beneficiary for your superannuation entitlements. 22.01.2022 Financial abuse of the disabled and the elderly is not a new issue, but unfortunately it appears to be on the increase. We have both been involved in many legal matters concerning the financial abuse of a vulnerable person (often involving the misuse of an Enduring Power of Attorney). The legal problems that arise from the misuse of an EPA are often difficult to resolve and cause families much pain. We are mindful of this when drafting EPAs for our clients. We seek to ensure that an informed decision is made by our clients and that they understand the significant role and responsibilities of any attorney they appoint.

Old age and death are coming for all of us and as Kochie notes at number 14 of his list, you should make sure you keep your important documents safe. 04.01.2022 Elder Abuse - A national register for enduring powers of attorney? We note with interest the following statement from the federal governments Budget 2018-2019 summary statement - "Funding is being provided to protect older Australians from abuse, including funding trials of specialist elder support services, and the Government will work with the states and territories to develop an online national register for enduring powers of attorney."... It will be a great leap forward if a national register of enduring powers of attorney is achieved.

01.01.2022 So often families enter into personal and financial arrangements with each other based on nothing more than verbal agreements, trusting each other to do the "right thing". It is our experience that not infrequently this leads to protracted and expensive legal disputes. As is explained in this article, much anguish can be avoided if legal advice and an appropriate agreement are obtained at the outset.
01.01.2022 Following on from our last post, this article highlights why it is important for some people to have documents such as an Enduring Power of Guardianship and Advance Health Directive (in which binding end of life directions can be recorded). This is a difficult subject to discuss. However if you have lost the capacity to make reasonable decisions for yourself, not having the right person appointed with the power to make medical treatment decisions or not having your end of life directions clearly set out (about what medical treatment you do or do not want to have) can cause great distress.
