Hi All, We are currently getting an incredibly high volume of queries relating to the ...specifics of SAPOL's decision on Gel Blasters, so what we think is a really good idea, is starting TOMORROW, I would love for each of you, if you have a burning question, to please call to make the query tomorrow. No matter what it is, no matter how complex, please call 08 7322 3346 tomorrow to ask it. If you aren't satisfied with the answer, I would also strongly recommend calling again within the next 2 weeks. Also I had a chat with Peter Clark today, the big cheques have been cut to the barristers so we would love for anyone considering to donate to protect their sport and past time to also please do so. 11.01.2022 Hi Guys, After what has been a pretty eventful few weeks, I wanted to share some good news into what has been going on behind the scenes and what is to come. I'...ve just been part of a telephone meeting with one of the barristers regarding the case we will be presenting against SAPOL in the supreme court. His exact words were he is 'incredibly relaxed' about the case. He has reviewed all of the legislation and regulation and is incredibly confident about what is to come from a legal standpoint. For obvious reasons, I'm not going to share the specific details of this, and to be honest if you don't know myself or Peter personally I don't expect you to, but I would like to add if there was ever a time to show trust in the community, now is the time. From a personal standpoint it is also fantastic to hear someone speak like this when I know how much businesses have suffered via unlawful decisions made by SAPOL and the firearms registrar. The other part of this that will be incredibly rewarding, is that once this is done and dusted, it should also open up SAPOL and the SA Government to pay compensation, to not only business owners impacted by this but also private owners that have handed in their blasters or had them seized. While I say this, please be aware that doing something dumb, I expect you will be punished in accordance with the law, however do get familiar with the legal term 'arbitrary deprivation of property'. So what do we need from you now? For those that haven't seen it, I have again attached the FOI of communications between the Police Commissioners office and Local Ministers. If you for one minute think that the government hasn't played a part in this, you are wrong. So let's make a stand. We need to apply as much political pressure as possible and make sure that they know where your vote is going if they don't have a viewpoint because after court is where the real battle will begin. 03.01.2022 This is the core depth of our discussion held with SAPOL yesterday afternoon: 4:07pm - 4:41pm Thursday 1st October Police HQ. SAGA: Ryan Richter (Communicatio...ns officer) SAPOL: Superintendent Stephen Howard (his assistant joined our meeting part way through) Superintendent Steven Howard: "It is my and the registrars perspective that gel blasters are now a firearm based ONLY on the fact that we believe the firing mechanism uses compressed air to fire a projectile." "Gel Blasters have evolved over time with heavy modifications including plungers batteries etc" "Section 4 in the firearms ACT states compressed air therefore blasters are definitely a firearm and need regulation" (When questioned if in fact gel blasters actually displaces the air as what we believe how NERF, Displacement pipettes etc work, compared to compressing, the response given was that we are getting too technical). "A gel blaster in South Australia is only to be classed as a firearm purely to the fact that it compressors air to fire a projectile. Not on how it looks, as people make real firearms colourful to look like toys". (When questioned about the Nerf comparison, little detail given besides given the regulations 5 of the Australian standard for projectile toys which outlines why a NERF blaster is regarded as a toy, nothing about NERFs firing mechanisms and or modifications that see nerf easily able to shoot 300fps and become full auto). "SAPOLs stance on gel blasters in regards to these regulations involving firearms licensing is just not negotiable." " If it looks like a duck, sounds like a duck, its a duck" (quack quack) "Under the proposed firearms licensing regulations, basic modifications won't bother us, however, if a blaster is modified to shoot anything other then a gel ball, (bbs etc) thats where they would take matters further". "The Crossbow / Prohibited weapons situation is muddy water. Putting blasters under that would actually restrict them". "I received phone calls by 2 local retailers before our meeting today who wanted to let me know before you came in that SAGA do not represent the gelball industry at all, it sounds like there is quite a bit of divide within the community". (He did then say that he preferred to keep the open discussions going between us as we have a very strong following in the gelball industry. We know who rang but will not dwell on it as we have dealt with it at a higher level an we have obviously more important issues to deal with then a couple small people attempting to undermine us) "We want to see responsible firearm owners. The days of people buying bulk blasters and selling from their backyards are over. Regulations will mean holding gel blaster owners and sellers accountable." "No legislative changes are required for these regulations to take place as its clearly set out under the Firearm Act". "Read section 3 under the Act to understand the effect and need for regulation." "We don't think these regulations will mean the end for the gelball industry, it will just need to adapt like everything else". "We encourage the sporting use of gel blasters, it will help legitimise the industry". Think we can see where this is going, but its not all gloom and doom. We have a very strong argument to protect gelball in SA. Either we fight the 1 single point used to over regulate gel blasters. Or we allow these firearms regulations to go through and we play, import, sell gelball blasters as licensed firearm holders. Its pretty simple what we have to do. We have already discussed these findings with the GBAA and GBAInc and will present a plan to do what WE ALL can together to save this industry and sport from being completely overregulated to a point where all the small businesses have no choice but to close in SA.
