25.01.2022 Another tax for Victoria? The Victorian Government has recently announced its intention to bring in a self-reporting Vacant Residential Property Tax (VRPT). The new 1% tax will be levied on dwellings that are vacant for more than a total of 6 months in a calendar year.... Owners of vacant residential property will be required to notify the SRO Vic of any vacant properties that they own. Note that some exemptions will apply. 23.01.2022 Have you been left out of a Will (or there is no Will) and need to challenge? Lets take one such example: Your defacto partner has recently passed away leaving no Will. You are now facing abusive and aggressive family members of your late partner who are questioning your role in the relationship. What should you do?... In Victoria, if there is no Will left behind by a deceased, the list of beneficiaries are generally as follows: - If survived by one partner and no children, then the partner is entitled to the whole estate; - If survived by one partner and children, then the partner is entitled to: o The personal chattels of the deceased; o The first $100,000.00 of the estate (excluding chattels); o A third of the remaining estate; - The children are entitled to equal share of the remaining estate after the partner has received his/her entitlements Even if there is no Will to be located, you will still be able to claim your entitlements provided you are able to prove your relationship with your late partner to the Courts. 22.01.2022 Increase in foreign property investor Victorian stamp duty .....taken from "Investor Alert" article by Steve McKnight from propertyinvesting.com: "A game changer has been announced that will impact Aussie property investors, particularly those in Victoria.... Earlier today, the Victorian Treasurer - Tim Pallas - announced that from 1 July foreign purchasers of Victorian real estate will pay the normal stamp duty PLUS an extra 7% of a property's value. It should be noted that this is an increase (to 7%) from the the already imposed 3%. As an example, an Aussie citizen buying a $700,000 home in Victoria would pay stamp duty of $37,070. A foreigner buying today would pay $58,070. A foreigner buying after 1 July 2016 will pay $86,070. That's 12.29% of the purchase price. Ouch. There is also a nasty little increase to land tax too for 'absentee owners' - an increase from 0.5% to 1.5% Although the Treasurer spruiked that Victoria is the favoured place for foreigners to park their money, the Australian Financial Review reports that "Purchases of new properties in Victoria by foreign buyers fell to 10.7 per cent in the three months to March from 32.5 per cent in December 2014." Why is this newsworthy? Well, it seems the lessons of the failed NSW government attempt in 2004 to slug all property owners with a exit stamp duty of 2.25% have been ignored. All that did was pour cold water on the property market and create a political stench that still lingers in the nostrils of NSW property investors. Economics 101 says if you increase the cost of business, that business will move to a more efficient (cheaper) market. In this case, anywhere other than Victoria. Take away that demand and unless the number of houses available for sale diminishes too, price must fall. But hang on... there has been a glut of new apartments approved over the past 12 months, so the supply pipeline is gushing and now demand has been throttled back! Nuts! Victoria loses, everywhere else wins. That said, there may be a scramble for foreigners to sign up contracts between now and 1 July so as to only have to pay a 3% surcharge. Developers better fire up their marketing campaigns fast. The property market in Victoria is already peaking. A dumb announcement like this may result in some political high fives by the boffins in the bowels and back rooms of Parliament, but for those in the real world, this will hurt sentiment and push buyers to other markets. 17.01.2022 Stamp duty changes for land transfers between spouses/de facto partners.. Property transfers between spouses or de facto partners involving commercial and/or investment properties will no longer be exempt from stamp duty for contracts entered into from 1 July 2017. However the exemptions for the principal place of residence and for transfers following a relationship breakdown will remain in place..

12.01.2022 Changes to the First Home Owner Grant and stamp duty FHOG changes The Victorian Government has announced that it intends to increase the First Home Owner Grant (FHOG) from $10,000 to $20,000 for new homes built in regional Victoria and valued up to $750,000.... This will apply for contracts signed from 1 July 2017 to 30 June 2020. Eligible first-home buyers of new homes in metropolitan Melbourne will continue to receive the $10,000 FHOG. Stamp Duty Changes The Victorian Government has announced that stamp duty (land transfer duty) will be abolished for first-home buyers purchasing a home with a dutiable value of not more than $600,000. This will make the existing first-home buyer 50 per cent duty reduction that applies to the purchase of a home with a dutiable value of not more than $600,000 a full exemption. Further, duty will be phased-in for eligible first-home buyers who purchase a home with a dutiable value between $600,001 and $750,000. Subject to the passage of the State Taxation Acts Amendment Bill 2017, the new measures will apply for contracts entered into from 1 July 2017. 09.01.2022 1. POWERS OF ATTORNEY LAW CHANGES There are various types of Powers of Attorney one can have made enduring and non-enduring ones. Power of Attorney laws changed on 1 September 2015 with the commencement of the Powers of Attorney Act 2014 ... The changes have not affected the medical enduring power of attorney which continues to be regulated by the Medical Treatment Act 1988. What has changed is the enduring power of attorney (financial) which has now been combined with the enduring power of guardianship forming a single enduring power of attorney. Additionally, a new type of power of attorney appointment, the supportive attorney, has become available. A supportive attorney can be appointed by an adult (who has decision making capacity in relation to making the supportive attorney appointment), to provide support to make and give effect to some or all of their decisions. Any powers of attorney and guardianship made before 1 September 2015 are still valid under the new Act. 09.01.2022 Something to think about over the long weekend.....why make a Will ? Every adult should have one!!! It is so important not to put it in the too hard basket.... Here are some reasons why you should make a Will: 1. You dont want the state to decide who gets your property Without a Will, the laws of intestacy determine who gets your assets. Clear instructions in a Will can go far to ensuring that those you want to benefit, inherit. Without a Will there just might be someone out there that you did not intend to benefit, that gets a piece of the pie! 2. Who looks after the kids? Legally appoint a guardian of your kids in your Will. Otherwise, a court may decide who looks after them and it may not be someone that you want for the job. 3. Avoid family conflict New laws in Victoria limit who can contest a will. So make it clear in your Will who is to benefit for the avoidance of doubt. For extra good measure, make clear notes as to why you have made such decisions and these notes can be read together with your Will. Make sure you also update your will if your family circumstances change. For example, you get divorced. 4. It s not that costly Get it drafted by a lawyer, it can be one of the most least costly forms of legal advice. It is very important that the Will complies with the law in every respect to be valid. Your Will indicates your intentions and provides certainty for those you leave behind. 09.01.2022 Verification of Identity (VOI) and Authority requirements for conveyancing transactions in Victoria Commencing 9 November 2015, all lawyers, law practices and conveyancers are required to take reasonable steps to verify the identity of each purchaser and seller of property (to a paper conveyancing transaction). The Titles Offices prescribed Verification of Identity Standard requires the person conducting the verification (the Verifier) to meet face to face with the perso...n whose identity is being verified (the Declarant). At the verification meeting, the Declarant must produce original documents in certain categories. At the VOI meeting, the Verifier will obtain copies of the original documents and certify that the original was sighted at the meeting. Porto Grace & Drew Lawyers have engaged two VOI agents to conduct VOI compliance at your convenience, either at your home, workplace or at a participating Australia Post office. For VOI at your home or workplace, please refer to our agent Zip ID to ascertain whether your work or home suburb is within their service area. Alternatively, please visit a participating Australia Post office for your identity to be verified.
