The proceedings were conducted by our Nicholas Rossi.... Our client is a Papua New Guinean National who resides with his family in rural Papua New Guinea, 10 hours away from a main city. The land on which he resides with his family is passed down through the generations according to customary Papua New Guinean law. In 1982, the deceased, an Australian National, was found by our client’s cousin wandering the street of Lae City, Papua New Guinea, and was subsequently taken in by our client’s cousin. In 1987, the deceased made a promise to our client that if our client as tribal leader looked after him and allowed him to reside within the community, the deceased would give his property in Queensland, Australia, to our client. Consequently our client gave the deceased food, shelter, clothing, and even built the deceased his own dwelling so he could reside within the community. In 2007, when the deceased passed away the promise the deceased made to our client remained unfulfilled. In 2018, Platinum Lawyers rose to the challenge of enforcing the promise of deceased, with a view to make good the detriment suffered by our client should the promise remain unfulfilled.
