22.01.2022 What is Victoria's current legislation? In Victoria, we currently have 3 different sets of compliance standards for swimming pools. The regulation that your pool must abide by depends on the date in which it was built. These time frames are...... Before 8th April 1991, Between 8th April 1991 30th April 2010 and; After 30th April 2010. Some key issues applicable to all time frames are: -Swimming pool gates must be self-latching and self-closing. -Safety barriers must not be installed near trees, barbeques or other climbable objects. -Moveable objects such as pot plants and chairs must be positioned away from the barrier. -It is illegal to prop open the pool gate. It's important to note that the when we talk about pools and spas, this covers bodies of water that are over 300mm deep. This means inflatable and movable pools and spas, ARENT exempt from the law, and require a safety barrier that meets the Australian standards. It is easy to check your fence has self latching and closing gates and the barrier is clear from climbable objects. BUT... Do you know if your fence is compliant at all? If you purchased the house with a pool or you are renting, you may be living with a non compliant pool. This poses dangers but also could put you at risk of very hefty fines. Below are some examples of non compliant pools: The balcony used as part of the barrier is 1000 mm and needs to be 1200 mm The back fence made of mesh is over 3 metres high however a supporting diagonal beam is climbable and non compliant The back fence forming part of the barrier is under the required 1800mm and has railings that are closer than 90mm apart There are many reasons a pool fence may not be or is no longer compliant.
