25.01.2022 apply tomorrow in Victoria. It is important to note that you may request an employee to work on public holidays if the request is reasonable. However, an employee may refuse the request if it's not reasonable or if the refusal is reasonable. When these days come up we have people in our community that aren't clients call up and ask " ?" Full-time and part-time employees who are absent ...from work because of a public holiday should be paid their base rate of pay for the hours they would otherwise have worked. If an employee works the public holiday they may also be entitled to for each hour worked on that day, or time off in lieu, or equivalent time added to their annual leave in respect of each hour worked on that day. Employees are not entitled to payment if the public holiday falls on a day that they do not normally work and casual employees will not receive any entitlement if they do not work on a public holiday. Do the right thing tomorrow. And if you are unsure what penalty rates apply for your Employees tomorrow, please get in touch with one of our team or send through a DM
25.01.2022 Today is my sons third birthday, and gosh has it been a tough few years but oh so rewarding. From being told I would never conceive to receiving a beautiful surprise pregnancy, and then being a single mum. Harrison is my rock and my why! He is the reason I work as hard as I do to make change and make a difference. I am so proud of how resilient he is, how strong he is, how much he cares for others and understands other peoples emotions. He teaches me so much each and everyday and he has helped me grow as a person too! If you have met Harrison you will know what a kind person he is and I am so lucky to be his mumma! What a gift I have to make me smile and laugh each and everyday!
23.01.2022 Restaurants, bars and cafes are set to reopen on October 26 at the earliest for outdoor seating . Some of our best leaders in the industry have called for the hospitality roadmap to be re-evaluated launching #ItsTime #unlockhospitality campaign. The letter reads "We do not take the health of Victorians lightly. But we believe the industry can safely reopen sooner than this road map specifies. We want to save jobs and livelihoods, to mitigate the negative impact on ment...al health, and help bolster the Victorian economy during this dire time." - Here at Positive HR, we sign the petition in support of this and hope Over 68,000 people lost their jobs, re-opening the sector will allow some of these people to be reinstated and return to work. We have seen firsthand the devastation COVID-19 has had on the hospitality industry and those that work in it. So we wanted to write this post to remind you to support hospitality, and here are some ways you can do it. Call and order direct through your local cafe to pick up a smashed avo for breakfast or use platforms such as @hungryhungr._ instead of ubereats Grab a coffee and why not pay it forward for another one, or grab a croissant at the same time Order your wines from local restaurants and Melbourne based suppliers. Shout out to the amazing team at @samuelsmithandson and @negociantsaustralia for supplying me with my wines and of course @simply.wines for my wine glasses Pick up lunch a few times during the week instead of making it at home. Ask yourself, if you weren't in isolation, would you have purchased lunch out - most times the answer is yes...so keep doing it! Organise a date night and have dinner delivered by @providoor - this could even be a Friday night dinner with friends on Zoom! Write a review on google or the venues facebook page. Share, comment, tag, like spread the word - this means so much to them! As you can see there are several ways to #supporthospo and help them exist on the other side of this. Tag your favourite venue below and let's spread some hope and love to #melbournehospo ! See more
23.01.2022 & Businesses that remain open are feeling anxious and are taking all measures to mitigate the risk of a positive case of COVID-19 being confirmed in the workplace. In this state of emergency and pandemic, timely notification of potential workplace transmission of COVID-19 is critical! ... -19 : - an employer becomes aware that an employee or contractor has been confirmed positive COVID-19 result, and has attended the workplace in the last 14 days prior to receiving results - a self-employed person has received been confirmed positive of COVID-19 and has attended the workplace in the last 14 days prior to receiving results. 38 & . - penalty of up to $39,652 for an individual - penalty of up to $198,264 for a body corporate These are temporary changes that will expire in 12 months, but will be reviewed during this time. 23.01.2022 - ! For most of the year, the only things we could control were our feelings and how we showed up every day. It has taken courage from all of our clients to keep showing up to customers, to have a brave face and try to stay positive, to be vulnerable and cry on an Instagram story - we have all had our own journey's through this pandemic. ... But as I learnt from Cherie at @thedigitalpicnic last night through a @shementors event, showing up has supported your business growth! You may not have seen a return yet, but showing up even when times are tough in business is connecting with your community. And guess what - your community are your customers and people that buy from you. So, keep showing up, being vulnerable, having courage, stepping outside your comfort zone and you will continue to watch your business grow. How are you going to show up and be seen today? 23.01.2022 ? As a business owner, this may be a question that you’re asking yourself and there are a few things to weigh up before making your final decision. Firstly, you need to be aware of the risks that come with working from home. This can include physical injuries due to having an inadequate work environment. You absolutely must implement a policy which outlines an employee’s obligation to maintain a safe... work environment. We have our remote pack available over on our website. Secondly, managing employees through an online environment has its own challenges. This can be due to having less control over employee performance as well as a stronger need to maintain constant communication. Ultimately, if your business is able to minimise any potential risks which come with having employees work from home, then this ‘hybrid’ workplace setting can be extremely beneficial and flexible for you. Our best advice is to communicate with your employees, ask them what they are seeking and come to a mutual agreement. Any questions don’t hesitate to contact us See more

19.01.2022 Kick your heels up, make yourself a cuppa, and let's chat Performance Reviews. More often we hear "reviews are useless, but they just have to be done to tick the box". Let's break down a few elements of the review. ?... - If implemented effectively, they create openness, accountability & transparent conversations. - Allows for recognition & acknowledgement to occur, and reinforce behaviour that is desired. - If Goal Science is applied you will be able to monitor self progress, and align to individual and business goals. ' ? - Unconscious bias is deeply ingrained and can influence a reviewing manager's behaviour. Various types of bias may occur (Halo, Recency, Contrast). - They may not take into consideration an employees reactions, do they think it has been a fair process? How will they perform after the review? - Can impact employee mental health with increased feelings of uncertainty and being anxious. ? - Define purpose of the review process - Understand business goals, values and expectations - Use continuous performance management data (regular feedback and 1 on 1s) - Strength orientation - Clear measurements And so much more! Let us know in the comments below how do you feel about performance reviews? And if you need help discussing a strategy for your business book a free consult today! See more

18.01.2022 Today were recognising National #EqualPayDay; a day that reminds us that the pay gap is still very much a reality for women not only nationally, but globally too. This years theme is Keep Minding the Gap, and with that in mind, were shining a light on some of the realities women in the workforce face today. Lets start with the disproportionate impact COVID has had on women. Not only are women shouldering the burden of caring responsibilities, but theyre also largely s...houldering homeschooling responsibilities in addition to their current workloads. The ripple effects of this are set to impact their long-term economic security and rates of workforce participation. Beyond the impacts of COVID, these are the challenges faced by Australian women in the workplace: ~ On average, women are earning 14% less than their male counterparts. ~ Women earn on average $253.60 a week less than men. ~ On average, women retire with 21.6% less superannuation than men. ~ It will take 32 years for women to be at economic parity with men. ~ Women would need to work an extra 59 days to earn the same as men this financial year. The work women do is just as valuable as the work men do, and at the very least their pay needs to reflect that. Today - National Equal Pay Day - marks 59 days until the end of the year. The same 59 extra days women are working to close the financial gap. Tell us, what would you do with an extra 59 days? #EqualPayDay2020 #KeepMindingTheGap

15.01.2022 As the COVID-19 pandemic extensively disrupted work environments, the first precedence has been crisis response: emphasising health and safety, critical offerings, and the virtualisation of work as we once knew it. Resilient leaders pivoting from the respond to recover levels and in the long run to thrive are those that focus on reopening and/or restoring the workplace correctly, efficiently, and in particular appropriately. While a return to work is a welcome move for businesses who have struggled with the disruption, it's important that it's handled with care. We have put together a free checklist to help support your business when the time comes to reintroduce your workforce. 14.01.2022 For most, working from home was a dream scenario pre-COVID-19. The perks are obvious; no commute, no morning rush, more time flexibility and more time with family. However, these 'perks' become a little challenging when you're faced with no other options and current news influencing your headspace.... Here are some tips we've found work quite well: Set up your workstation in a clutter-free space in the same way you would if you were physically in your office, Remind your family and housemates of your work hours, Set reminders to get up and stretch, go for a walk or simply get more water, Have lunch away from your desk, and Keep in contact with your colleagues For us, it comes down to mimicking a day at the office as much as possible and allowing for small distractions to pop up. 12.01.2022 The Federal Government obtained approval for the extension of the JobKeeper wage subsidy for an additional six months. There were also some tweaks to the JobKeeper provisions in the Fair Work Act 2009. This means employers need to reassess their JobKeeper eligibility as there are new flexibilities depending on whether an employer is a 'qualifying' or a 'legacy employer'. : ? ?... : Employers who previously qualified, but no longer qualify, for the JobKeeper scheme are called legacy employers. Legacy employers can still use some of the JobKeeper provisions if they can confirm they have suffered a 10% decline or more in turnover for the previous quarter. For previously eligible employees, a legacy employer can still proceed with a JobKeeper enabling stand down direction. However, the employee must not work less than 60% of their ordinary hours (as at 1 March 2020) or less than two hours a day. Legacy employers can also make agreements with employees to work on different days or times. 09.01.2022 About 20% of the Australian workforce are employed as casuals. Casual employees are often hired when an employer requires someones on an irregular or ad-hoc basis. There has been a big focus on casual employment a result of the Workpac vs Rossato decision. The Federal court found that an employee of labour-hire company, WorkPac Pty Ltd (WorkPac) engaged and paid a casual was in fact other than a casual employee. This entitled the employee to annual leave, compassionate lea...ve and personal leave. As a business owner, you need to make sure you are properly protected. Only having a verbal contract means there is no evidence to prove what was agreed. The greater the risk is of conflict and disputes when you do not have written employment contracts, that clearly articulate the type of employment and relevant terms and conditions. An employment contract is not only important to protect your business, but it also provides clarity and ensures the employee is fully aware of their entitlements and obligations. We were so glad to have helped Clare protect her business with new legally legit employment contracts and a compliance audit. If you need support book a free consult in today.

06.01.2022 Employers found to be deliberately underpaying their employees will now face jail time under new laws passed in the Queensland Parliament. Back in June, Victoria was the first state to pass laws, making it an offence for employers who intentionally withhold wages and other employee entitlements. It won't be long before the other states and territories follow suit. The laws come as no surprise. We seem to hear big brands like David Jones, Bunnings and IBM shortchanging their staff almost every day. It makes us wonder how large corporates can get it so wrong. This means that despite our best efforts and intentions, small business owners are not entirely immune from underpayments. #HR #tradieshr #underpayment #wagetheft
05.01.2022 What an unpredictable year 2020 has been! With entering a new financial year, it is now the time to be and get . After receiving just last week alone from businesses asking about contractors vs employees we thought we would deep dive into that very grey area. As a general rule of thumb, the relationship between a business and an employee is a contract service, while the relationship between a business and a contractor is a contract service.... ' - People who do only one day a week are automatically a contractor, not an employee. - I have a contractors agreement that says I don't need to pay super, so I don't need to. - They provided me with an invoice so that is enough evidence to prove they are a contractor. - They asked to be a contractor so I won't get "in trouble". 04.01.2022 ' You are breathing an enormous sigh of relief following the High Courts decision restoring common sense to how personal/carers leave should be calculated under Australias workplace laws. In the controversial Federal Court decision in Mondelez v AMWU, the High Court supported the common understanding of calculating personal/carers leave entitlements.... The Fair Work Act 2009 (section 96) states that each employee is entitled to '10 days of paid personal/carer's leave. The Mondelez case essentially tested what 10 days actually meant. The Federal Court interpreted this as 10 days, no matter how many hours an employee would ordinarily work within a 24-hour period. This was problematic for many businesses because if they had part-timers, even if they worked 1 day a week, they would still be entitled to 10 days of sick leave a year. The High Court has stated that what is meant by 10 days must be calculated according to an employees ordinary hours of work across two standard working weeks. Employees working 76 hours across a fortnight, for example, would receive the same personal leave entitlements irrespective of whether those 76 hours were worked across eight shifts or ten. https://positivehr.com.au//high-courts-judgment-a-win-for-

02.01.2022 From our community to you, ARE YOU OKAY? Positive HR advocates for preventative measures such as self development and supporting employees to building emotional resilience. It starts with loving yourself. A plan of action for your business is to assess the current environment within your workplace - ask yourself what level of understanding do your employees have about mental health and mental illness?... Develop an inclusive workplace environment where diversity is welcomed, supported and protected for all employees. Speak openly about suicide and mental health in the workplace. Implement policies and procedures relevant to suicide prevention- have a procedure on supporting someone who may be at risk of suicide or has attempted suicide. Be able to recognise potential language of a troubled employee. Develop your emotional intelligence to understand how to read other peoples emotions in order to recognise the early warning signs. Know how to respond and educate your leaders. The most important part is to let them express their emotions and for you to listen. If you have any questions on managing mental health in the workplace, dont hesitate to get in touch. #tradieshr #mentalhealth #ruokday2020 #ruok
