18.01.2022 Australian Business Visa: IMPORTANCE of using #IMMIGRATIONLAWYERS We have been contacted by a number of people who have lodged their own state #business nominations and some of these people may are very likely to have problems when they are asked to lodge a visa application. Receiving a nomination approval and an invitation to lodge a visa is the easy part. A visa application needs to support and prove the claims you made in the nomination and also meet the character and me...dical requirements and past travel and visa history. From what we have seen the main problems for those who have lodged their own nominations are but not limited to: Financial statements and accounts are not in an approved format Points incorrectly claimed in the nomination (minimum 65 points needed) mainly with points claimed for qualifications, assets (such as business valuation) not held for long enough or incorrectly calculated Ownership level of the business is insufficient and cannot easily be supported by the documentation We want everyone who wants to come to Australia on receive the visa they have applied for. Anyone who has self-lodged a nomination needs to be aware that a visa application is much more complicated and, if done incorrectly and refused, will not receive a refund from the government for their application (currently this is a minimum of $AUD10,900 for a family of 4 people). Alasdair Dougall recently finalised two successful cases under the Regional Employer Sponsored Stream Visa Program, the Subclass 187 Visa. Both cases involved Retail Managers, both cases involved Franchise Agreements. This was identified well ahead of time as a core issue, as the control of a Master Franchisor can create doubt for both the Department and the Tribunal as to whether the remainder of the roles left for the employee after those controlled by the Franchisor is sufficient to be classified as a Manager; or whether the role has been watered down to that of a Supervisor. As the employer and the employee were briefed and advised well in advance of the Hearings, they were able to present evidence from the employment that the franchise agreement did not reduce the role to that of a Supervisor. Even though once of the Franchise Agreements involved very strict control measures over business operations; it was still accepted that the employee was performing the full range of duties as a Manager.
