11.01.2022 Are you planning to buy a property OFF THE PLAN? An off the plan contract is a contract for the sale of a lot that does not have a separate title at the time the contract is entered into. Off the plan contracts are used by developers to pre sell vacant land lots or strata units before the necessary building and contract works have been finalised. A sunset clause is a provision in an off the plan contract that provides for a contract to be rescinded if the lot is not created... by the sunset date. Sunset clauses in the past have been a great concern to buyers where some developers have used them as a way of terminating an off the plan contract specifically for financial gain. On 17 November 2015, the NSW Government passed new laws to insert a new Division 10 in the Conveyancing Act 1919 which aims to provide further protections for buyers in off the plan property contracts and aims to prevent developers from unreasonably rescinding off the plan contracts for residential properties under a sunset clause. New capital gains tax rules are in effect as of this month and if you are buying or selling real estate in Australia for $750,000 or more, it is important to be aware of the new Capital Gains Tax Withholding rules and how it affects you. From 1 July 2017, the seller must provide to the purchaser, prior to settlement, a clearance certificate obtained from the ATO. ... Without the certificate, the purchaser is required to withhold 12.5% of the price and pass it on to the ATO. This would mean that the seller would need to wait until they lodge their income tax return before they can recover the withheld amount. The laws were introduced to tackle the problem of foreign residents selling real estate and avoiding their capital gains tax liabilities. In practice, however, it means that a large number of regular real estate transactions not involving foreign residents are also impacted. The changes apply to real property disposals where the contract price is $750,000 and above (previously $2 million) and the FRCGW (foreign resident capital gains withholding) tax rate will be 12.5% (previously 10%). The ATO recommends applying for a clearance certificate at least 14 days before you actually need it.
