05.01.2022 Recently the Supreme Court of Queensland handed down a decision that confirmed that an unsent text message constituted a valid Will. It is extraordinary to see how the law has changed over the years with the use of technology. We must all be mindful that in our modern technological society, any written publication (which includes text messages, posts on social media forums and the like) is still a written record, even in draft form as this one was, which will bind the author ...of such written record and will always have consequences, whether desired or not. It is so important to see a solicitor to ensure you have an up to date Will that actually reflects your current wishes. Wills are not set in stone and can be changed at any time provided you are able to change it. Many people are wary of making a Will as they believe it is a document that cannot be touched once made.
