21.01.2022 Supreme Court confirms $1 million inheritance in NSW Trustee and Guardian v Hirsch [2013] NSWSC 1397. The case concerned a Will written without the assistance of a lawyer. The executor of the Will contended that the terms of the Will were so uncertain that it was not clear whether the Willmaker intended to give anything to our client. The court accepted that it was clear that our client was to receive the property. 12.01.2022 On 24 September 2013, the Federal Circuit Court has delivered a judgement (Kim v Minister for Immigration & Anor [2013] FCCA 1433) concerning defective notification of migration decision finding against the Minister for Immigration and Border Protection and his Department. The court found that where an applicant provides two addresses in their visa application, any correspondence from the Department of Immigration and Border Protection (DIBP) must be sent to both addresses ...but not only one. There have been many court decisions dealing with defective notification over the years.
