25.01.2022 This is an interesting observation which shows the different attitudes of society - largely influenced by the politically correct brigade and Government. Men are often the victims of domestic violence yet no recognition of that fact in s.9(3) of the Crimes (Domestic and Personal Violence) Act 2007 (NSW). That section, among other things, recognises "that domestic violence is predominantly perpetrated by men against women and children" and that it occurs in all sectors of the ...community and yet, despite that universal embrace, the recent amendments of course had to include "...Aboriginal persons and Torres Strait Islanders, persons from culturally and linguistically diverse backgrounds, persons from gay, lesbian, bisexual, transgender and intersex communities, older persons and persons with disabilities". No mention of it also occurring by women against men. It is not uncommon for Police to ignore men's complaints and take the woman's side even when the evidence points the other way. It will become an even bigger industry with the recent changes which removes the subjective test requiring that a person "in fact fears" All that is required under these changes, for an Order, is that "the court is satisfied on the balance of probabilities that the person has reasonable grounds to fear...". Violence of any kind cannot be tolerated but let's keep a hold on reality. See more

12.01.2022 ARE YOU A DISQUALIFIED DRIVER? CAN YOU GET YOUR LICENCE BACK? If you are disqualified from holding a driver licence, and will be, for a number of years into the future, chances are you may be eligible to apply to have that disqualification either reduced or removed completely. Over the last 40 years, driving laws have changed dramatically in numerous ways. One of those changes has been disqualification laws. In 1999, draconian legislation was introduced which not only saw d...isqualification periods doubled, but in the case of repeat offenders, quadrupled, and on top of that, for those who offended three times in any 5 year period, the addition of a declaration as HABITUAL OFFENDER, which saw a further 5 years being added to the disqualification period. Once a person got onto the tread-mill, they could never get off, and in many cases, people were being disqualified for 20 30 years. The result was that the offence of DRIVE WHILST DISQUALIFIED was becoming a far too common offence in the court system. In 2017 the Berejiklian Government, sensibly saw the exponential effect that these laws and their results were having on society generally and took measures to remedy the situation by enabling those who have lengthy disqualifications, to have part or all of their disqualification period removed. How do I apply for a disqualification removal Order? If you have been offence free for a period of 2 years (4 years in some cases), then you may be eligible to make application for any outstanding disqualifications to be removed. Note: this does not apply in cases involving serious motor vehicle offences under the Crimes Act such as murder, manslaughter, predatory driving, police pursuits, causing death or grievous bodily harm and various other offences. However, if you have been offence free in the last two years and you have a further period of disqualification still to run, then you should fill out an application to the RMS for a copy of your traffic record. You will receive a response from them, probably within a month and if you are eligible, a box will be ticked indicating such, in the reply form. To get this application form - go to the RMS website, print it out, fill it out and send to the RMS : When you have received the response and you would like to engage a lawyer to act for you - call Proctor & Associates who will advise you as to your next move in taking the case to court and applying to have your disqualification removed. These laws neither create efficiency or fairness in the Justice system. We saw the creation of such measures post 9/11 and as suspected what was originally a rare exception for terrorism is becoming a standard approach the wider public. 02.01.2022 BAIL APPLICATION DURING COVID-19 CRISIS Bail applications might be more successful during the COVID-19 Pandemic owing to persons being in custody longer than otherwise expected before their case is heard. As recent as 31 March 2020, the Supreme Court (Rakielbakhour v DPP [2020] NSWSC 323 - 31/3/20) ... allowed bail to a person charged with Domestic Violence offences upon his wife. The wife made it clear that she didnt want to give evidence and explained her injuries exculpating the husband. After careful analysis of the case, the Supreme Court considered that very relevant to the question of bail (as observed in some Victorian decisions) was the delay in accused persons having their matter dealt with including a number of other factors caused through the COVID-19 crisis, such as the introduction of emergency legislation and restrictions on visits to gaols, inmates protecting themselves from infection and the possibility of infection spreading into the gaol system. Such considerations, the court held, that the concerns raised by the prosecution, were able to be mitigated by the imposition of strict conditions. The Court also held that there might be cases, depending upon the circumstances and evidence, where this pandemic will throw up issues relevant to the "show cause" question. 01.01.2022 COVID-19 FINES The Public Health (COVID-19 Restrictions on Gathering and Movement) Order 2020 (the Order), came into force on 31 March 2020. The Order requires that people in NSW are not to leave their place of residence unless they have a reasonable excuse to do so. Some examples of reasonable excuses to leave home are for obtaining food or other goods for personal needs or household purposes, including for pets and vulnerable persons, travelling for work if unable to work f...rom home, obtaining medical care or supplies and exercising. If you are approached by the police and issued with a fine, you should seek legal advice immediately to consider your rights and protect your interests.
