What this means is, if you are purchasing a property, you should immediately arrange insurance cover for the property upon receipt of the signed contract. 07.01.2022 When you sign up to buy or sell a house you are signing a lengthy legal agreement. It may come as a surprise to some people that the agreement you sign is not regulated by government. For existing residential property contracts, the most common agreement used is the REIQ contract. This contract has been jointly developed and published by the Queensland Law Society and the Real Estate Institute of Queensland. The terms of this contract are well known. Legal commentary and c...ourt decisions about contract terms are mostly around the REIQ contract which means there is considerable certainty regarding the interpretation of its contract terms. There are standard form contract alternatives to the REIQ contract. These contracts have not had the exposure to court decisions and legal commentary that the REIQ contract has had and there is therefore less certainty regarding the interpretation of their contract terms. Furthermore, the difference in terms in non REIQ contracts can mean different rights and obligations and time frames for conveyance processes. This requires more care in reading and understanding the terms of the contract and adjusting otherwise standard processes and documents. For off the plan contracts developers usually have their own rather extensive bespoke contracts. Property Law Centre recommend buyers and sellers should consider getting legal advice before signing a contract, but especially if there are special conditions to the contract or it is not a standard REIQ contract or it is an off the plan contract. Sarah is relocating to Brisbane to take up a new role in the management team of a major law firm where she will have the opportunity to apply her studies in marketing and media studies. Sarah started with Kelly Legal as an office junior on a traineeship and for a number of years has been the friendly face and voice greeting clients at reception or over the phone. She has also played a major role in establishing and maintaining the social media footprint for our legal practice.
