11.01.2022 Property settlement after separation Do not be blindsided or be pressured into signing anything. You can have a property settlement at any point after you have separated - you dont need to be divorced first.... The sooner you do it after separation, the less exposed you are to post-separation debt from your former partner, or protected from you acquiring assets post-separation that your former partner may have a claim on. In a defacto relationship, or you have made a significant contribution to another persons assets, that there may be a claim in relation to defacto property. It happens all the time in couples that one individual takes the lead on financial decisions and another is largely unaware of whats going on. It is important to seek professional advice as soon as practicable as the outcome of the settlement is going to determine whats possible for the rest of your life. A few things to note: * Everything, including cash or assets held including those held in a trust, goes into the asset pool as does liabilities (mortgages, credit cards, personal loans etc) and is up for negotiation. It is incorrect to think that cash or property held in one persons name is automatically theirs following separation or divorce. * The value of those cash and assets is not calculated at the time of separation, but rather at the time of settlement itself. * Superannuation can be split from one partys superannuation interest to another, to ensure that a just and equitable division of property can occur. * Inheritances or money gifted from family can be included from the asset pool, unless there is agreement and the timing of when the inheritance or gift was received will be important as well as any intention that the gift be repaid to your family.
