23.01.2022 Have you recently purchased a property that was sold to you as an 'off the plan' purchase? Off the plan refers to property purchases that take place before the property is completed and/or the Certificate of Title has been issued. A deposit is paid by the buyer and settlement occurs when the land is cleared or apartment complex is completed, which could be several months or years later. Many of the land developers did not predict the government grants and have now sold all ...titled land. You need to be aware of the time delays as they are working to ensure all titles are ready for settlement to meet the guidelines for the grant funds. See more
20.01.2022 HomeBuilder Grant did you know that you can still qualify for the grant on an off the plan apartment or townhouse. The conditions are 1. The contract to buy must be after the 4 June 2020 and before 31 December 2. The construction commenced after 4 June 2020 but no later than 3 months after the contract signed.... The importance is based on the construction commencement date not the issue of titles.

07.01.2022 As WA enters lockdown this week, please find below some relevant information regarding real estate transactions. Home opens With everyone in lockdown and visitors are not permitted in homes, it is reasonable to assume that home opens for properties for sale and rent will not be permitted.... Agents can still show properties through videos or walk throughs that have already been made. Individual guided inspections As everyone is in lockdown and visitors are not permitted in homes, it is reasonable to assume that an agent will not be allowed to take individuals to properties for sale and rent. Agents can still show properties through videos or walk throughs that have already been made. Periodic inspections It is assumed that periodic inspections will not be deemed essential and property managers will not be able to conduct physical inspections during the lockdown. Lease terminations If a lease is coming to an end and the tenant has agreed to provide vacant possession, then it can only be assumed that the tenant would have to stay in the premises and the lease would continue until the lockdown is over. It would be prudent to email the tenant to confirm the extension. Pre-purchase inspections It is assumed that pre-purchase inspections will have to be delayed until the lockdown is finished. It may be possible for a seller living in the property to be sold to conduct an inspection through their mobile phone/video device. Property settlements The following comments are made on the assumption that Landgate and settlement agents will be able to provide settlement services during the lockdown. If the seller resides in the property and settlement is scheduled for the lockdown period and parties in their contract have adopted REIWA’s COVID-19 Annexure (form 194) then the parties have already agreed to time extensions for their settlement. If the seller resides in the property and settlement is scheduled for the lockdown period and the parties in their contract have not provided for any COVID-19 occurrences, then it would have to be assumed that the seller would have to remain in lockdown in the property and the parties will have to negotiate an outcome. If the property is leased, then it is assumed that the tenant in lockdown would not be able to vacant the premises and the parties will have to negotiate an outcome. If the property is vacant, then it would be assumed that the settlement would proceed, and the buyer could enter the property when the lockdown terminates. WA Government COVID-19 information For more information, please refer to the official WA Government COVID-19 announcement. Please note that if the information above relating to real estate transactions changes, we will send you a further update. #logisticsetts

04.01.2022 Ways to settle on time before you sell. The average days on market has reduced to 17days in Western Australia. With many investors cashed up ready to go it is prudent for a seller that once they have made the decision to sell to make sure they attend to some simple things that can potentially delay the completion of settlement on the date set in the contract of sale. 1. Contact your bank to advise the property is being sold and receive the instructions on the best way to rel...ease the property. 2. Property compliance requirements for RCD and Smoke Alarms. 3. Do I need and ATO clearance certificate? 4. Have your identification completed at a time convenient to you and not at the last minute. All of these things require the services of a third party that may not benefit from the sale of the property so the request to have processed as urgent may not be urgent for them to comply. See more
