Read careful...ly work condition below. work limiting condition 8105 : In the wake of the exploitation of workers at 7-Eleven stores most of which turned out to be International Students it is now very important that students understand the work limitation conditions attached to their visa. Imposed on most Student Visas, condition 8105 limits the holder to working a maximum of 40 hours per fortnight while their course of study is ‘in session’. The ability to work starts once their course of study commences. A fortnight is defined as the period of 14 days commencing on a Monday. The 40 hours a fortnight: relates to any fortnight during which the course of study or training is in session cannot be averaged out over the duration of the course. For example, if a Student Visa holder works the following numbers of hours over a four week period after their course has commenced: week 1: 15 hours work week 2: 25 hours work week 3: 25 hours work week 4: 10 hours work.The student visa holder would not have breached their work conditions in the fortnight comprising the 14 days of weeks 1 and 2 (40 hours worked) or in the fortnight comprising the 14 days of weeks 3 and 4 (35 hours). However the visa holder would have breached their work conditions in the fortnight comprising the 14 days of weeks 2 and 3 (50 hours worked).A course is considered to be ‘in session’: for the duration of the University or College’s advertised semesters (including periods when exams are being held); if the studies have been completed but the Confirmation of Enrolment is still in effect (with the exception of masters by research or PhD students who have submitted their thesis); if a student is undertaking another course during a break from their main course and the points will be credited towards their main course. Students who complete their course as scheduled, have access to unrestricted permission to work while they still hold a valid student visa. However, visa holders should note that other conditions on the Student Visa allow the Department of Immigration to cancel the visa if the applicant is no longer enrolled in a course of study. Upon completion of your studies, the Department will generally not consider cancellation if you have applied for another visa to remain in Australia. Condition 8105 also states that ‘the holder must not engage in any work in Australia before the holder’s course of study commences’. The work rights are tied to the date of commencement of the relevant course of study. Depending on their circumstances, a student who applies for another Student Visa to undertake further studies may or may not be able to continue working. These circumstances include: Students who have been granted or have applied for a student visa, to enable them to complete a course for which an initial visa was granted, such as where the initial COE is extended, may continue to work Students on a visa associated with a package of courses may continue working between courses. Students who have completed a course of study and have been granted or have applied for a student visa to undertake a different course of study, are required to stop working from the grant date of the new visa and are unable to work until the new course commences. Breaching condition 8105 can have disastrous consequences for Student visa holders and their dependents as the Department of Immigration takes a very dim view of students who work more than allowed. Employers also need to be aware that they can be fined or sanctioned for allowing a person to work in breach of the conditions of their visa. Work rights and limitations can be checked quickly and easily through the Department of Immigration’s Visa Entitlement Verification Online (VEVO) system.

01.01.2022 BAD NEWS FOR 189 VISA : 2019/2020 MIGRATION PLANNING LEVELS RELEASED ******************************************************************************************...**** Department of Home Affairs released number of seats for migration year 2019-2020 total cap is set at 160,000. For 189 visa number of seats decreased from 43,990 to 18,652. It might lead to longer waiting and applicants would need high number of points for invitations.
