20.01.2022 After Channel 9's exclusive story last week, thousands of regional Queenslanders have joined the QLD Energy Class Action against Stanwell Corporation and CS Energy. Key points : There is no cost to join, registration is confidential, participation in the class action is anonymous and the class action is fully funded by LCM, an Australian litigation funder... Once registered, group members take a passive role in the litigation If we are successful, economic experts have estimated that participants in the action can expect to have a claim valued at approximately 15% of their annual spend on electricity (energy component of the cost stack) over 5.5 years plus interest. 16.01.2022 Lachlan Lamont, Special Counsel at Piper Alderman said, ‘Businesses and residents of Qld have been paying too much for their electricity for too long. The State’s two coal fired generators, Stanwell and CE Energy have misused their market power to inflate electricity prices throughout Qld. This class action is being advanced on behalf of all Queenslanders who have overpaid for their electricity. If successful, the action will provide compensation electricity consumers for being overcharged and prevent this misconduct from continuing into the future.'

16.01.2022 You are eligible to join the class action if you have paid for electricity in Queensland between the 2014 and 2019 period. This action is fully funded by LCM. 10.01.2022 12 January 2017 has been described by the Grattan Institute as a day of games. The figure below shows the five minute dispatch interval price by State for 12 January 2017. In Queensland there were 7 dispatch intervals at or near the market cap of $14,200 per megawatt hour, while most dispatch intervals were around $100 per megawatt hour in the other NEM regions. The Grattan Institute identifies the fact that strategic bidding behaviour is not reflective of supply and demand... conditions but instead indicates a gaming of the system. The Australian Competition and Consumer Commission (ACCC) has conducted an extensive inquiry into electricity prices in Australia. It has observed that on average the coal generators in Queensland set prices 65% to 70% of the time between July 2013 and March 2018. Stanwell and CS Energy are responsible for roughly 70% of the electricity dispatched into the NEM, meaning they yield a significant amount of market power.

If you are a business or individual who has paid for electricity in Queensland at any time between August 2014 and December 2019 you could be eligible to join the class action and claim compensation. Being a fully funded class action it is cost free and risk free to register and participate as a member.

09.01.2022 The QLD Energy Class Action is fully funded and risk free. What does that mean? It means a funder pays all the costs of running the action. It will also pay the defendants’ costs if the action is unsuccessful to ensure group members pay nothing out of pocket. You can become a member by registering your interest on our website.... 07.01.2022 One Big Switch has joined the QLD Energy Class Action in a bid to drive registrations to a total of 30,000. We received 8000 registrations last week and the current total is 25,700. Once we hit 30,000 we will file the class action in the Federal Court of Australia. If you are willing to register, but haven’t done it yet, we urge you to do so as soon as possible.

07.01.2022 To give you some idea of the scale of the issue in Queensland compared to other NEM jurisdictions, this chart is illustrative. The behavior dropped off a little in 2015 but then became even more prevalent in 2016 and 2017 despite the rule change coming into effect. 06.01.2022 Queensland Energy Class Action - KEY POINTS LEGAL BASIS - Qld's two largest electricity generators have been abusing their market power to spike energy prices at our expense.... - Piper Alderman's lawyers believe they can prove this is a contravention of Australia's national competition law, specifically s 46 of the Competition and Consumer Act 2010 (Cht). THE DEFENDANTS Stanwell Corporation Ltd and CS Energy Ltd - Two of Qld's largest coal powered electricity generators. - These companies sell electricity to energy retailers like Ergon, who pass the cost through to consumers like you. - Rough estimates indicate energy bills have been illegally increased by 12-16% since 2014. COST FREE, RISK FREE AND HASSLE FREE There is no cost to register - The costs are fully financed by Litigation Capital Management Ltd, an Australian litigation funder. There is no risk to participate in the action - The funder carries all of risks. Registration will take 2 minutes - You do not have to locate your electricity bill to register. - It will assist us if you can provide your electricity account number with your retailer (ie Ergon Account Number) and an estimate of your annual electricity spend. - Other than providing that information, there is nothing further for you to do but await the outcome of the action. 03.01.2022 Hi Queenslanders, Stanwell purchased similar domain names to the class action and is redirecting group members to their website and away from our registration portal. We ask you, why do you think they are doing that? Are they trying to confuse group members and prevent them from registering their claim? ... If, as they say, our claim is incorrect, why take steps to limit the number of registrations? It’s time to balance the scales of justice and do the right thing.
