21.01.2022 Who has health and safety responsibility when owner building? Everyone involved in construction work has health and safety duties when carrying out the work. Principle duty and responsibility falls directly with the building site controller or a person conducting the business of construction. In an owner builder environment, this is the owner builder. An owner builders responsibility is to ensure, as reasonably practicable, that all site visitors and workers are not expo...sed to health and safety risks arising from the construction works. Building sites have many various people attending or conducting construction duties, such as, surveyors, inspectors, contractors and delivery personal. It is common in the construction industry for a person to have dual or several roles when on site. For example, contractors and subcontractors can be persons conducting a business or undertaking but they may also be workers. 4 main duties of an owner builder before construction works commence. 1. Display a sign with contact details. Before construction work starts, the owner builder must make sure that a sign showing the principal contractors name (owner builders name) and contact phone number is placed where it will be clearly seen from outside the workplace. If there is a site project office, its phone number should also be shown on the sign. 2. Prepare a health and safety co-ordination plan and keep it up to date. The owner builder must make sure that a health and safety co-ordination plan is prepared for any construction work before the work starts. During the project, the principal contractor must review the plan to make sure that it remains accurate and deals with all the construction work actually being done. Make the co-ordination plan available for inspection. 3. Make sure all contractors and site visitors are aware of the co-ordination plan. 4. Make sure owner builder construction and public liability insurances are in place. Owner builders are particularly exposed because they face risk as both the principle site controller and the owner of the asset the property. Therefore to minimise and mitigate this double edged threat a quality insurance policy must provide cover against vicarious liability challenges. Vicarious liability imposes responsibility upon one person (and owner builder) for the failure of another, (for example a sub-contractor) to exercise care and diligence as reasonably prudent person would use under similar circumstances. Government and stat...utory bodies lead the way. But legal firms aren’t too far behind in writing up the downfalls of self building or home improving. Here are some facts: Over 40,000 Australians start an owner builder project each year; Legislating to close down owner builders such as recently in NSW and some time ago in Queensland has only pushed home owners to renovate without appropriate permits. Australia is not ‘russia’ and should feel entitled to build a front fence, or remodel a bedroom or erect a kit home and even build their own home, within the rules and regulations of our building Acts; Owner builder’s insurance claims are significantly less than builders and subcontractors. However fundamental construction site equipment such as portable loos, hoardings and fencing are common hire items. Hire Agreements are often complex documents with content layout and font sizes foreign to m...ost humans. Moreover hire company staff are known to hastily shift a Hire Agreement with pen under the owner builders nose with little time to review the actual document. In nearly all cases these Hire Agreements provide adequate damage waiver, but not always loss or theft. This means damage to equipment may be included in a Hire Agreement but not loss or stolen goods. Insurance is always about detail and knowledge, and often not knowing the right questions means you miss out on important information. FACT- MOST OWNER BUILDER INSURANCE PRODUCTS EXCLUDE HIRE EQUIPMENT FROM THE POLICY. When brokers introduce the topic that Care Custody or Control provisions may cover these hired goods they are wrong.
