23.01.2022 UPDATE FROM LANDGATE REGARDING THE STRATA TITLES ACT 1985 REFORM: "Milestone achieved! The Strata Titles Act Reform team is delighted to announce the Strata Titles Amendment Bill 2018 (STA Bill) passed Parliament on 1 November 2018, ushering in the most significant changes to strata in over 20 years.... During passage of the STA Bill, the Legislative Council referred Part 12 of the Bill (Termination of schemes) to the Standing Committee on Legislation. This review process involved an invitation for public submissions to the Standing Committee. The Standing Committees report was delivered on 16 October 2018, noting general support for Part 12 and made 10 recommendations to improve the safeguards. The government agreed with all 10 recommendations. Amendments to the STA Bill in response to those recommendations were passed by the Legislative Council and agreed to by the Legislative Assembly. What happens now? Landgate will now focus on completing the regulations to support the amended Strata Titles Act 1985. This will involve further consultation with public, government, industry and community stakeholders on those regulations. The Community Titles Bill 2018 (CTB) still has to go through the Third Reading stage in the Legislative Council. After that, the Minister will seek the agreement of the Legislative Assembly to the amendments made to the CTB by the Legislative Council." Watch this space for more updates! Good news, the wait is almost over! Proposed commencement date - 1 May 2020 ... The amended Strata Titles Act 1985 is proposed to commence on 1 May 2020. However, it is important to remember this date is subject to the parliamentary process and may change as a result. Landgate expects to provide confirmation on the proposed commencement date in April 2020.

19.01.2022 The Western Australian State Government is passing sweeping amendments to the Strata Titles Act 1985 (WA), the STAA 2018. These reforms are likely to come into effect in the next six to twelve months. The reforms will introduce new duties for strata council members. Key Points - if you are a council member you should:... *ensure you have complete information, *ensure you make decisions in the strata companys interests, rather than your own, *consider the duties outlined in the Act when making decisions, *keep written records of what decisions the strata council has made and how. WA council member liability - Breaches of these duties could lead to the removal of council members or make the strata company and/or council members liable for harm caused by the breach of those duties. Landgate has promoted the reforms by saying that council members will have protection from personal liability if they fail to meet some of these duties: To encourage people to volunteer for the council, the Act will state that a council member is not liable in any civil proceedings for any act that they do in good faith when performing the role of a council member. However, strata council members should be aware that the protection offered in the legislation is very limited. What are the new duties of strata council members? In the amendments, a council member will be obliged to: *act honestly, with loyalty and in good faith in the performance of their functions (the duty of good faith); *must exercise the degree of due care and diligence that a reasonable person in their position and in the circumstances of the strata company would exercise (the duty of diligence); *must not make improper use of the persons positions to gain an advantage for themselves or someone else or to cause detriment to the strata company. The duties also include duties to inform the council in writing of any conflicts of interest with the strata companys interests and must not vote on a matter on which they have a conflict of interest. Merely owning one of the strata lots is not a conflict of interest. Something more is needed, such as being the owner of a subcontractor seeking to work on the common property. Can a council member be personally liable? Strata council member duties - A council member may be personally liable unless they can show they acted in good faith in exercising their functions. If they have acted in good faith, then the strata company can be liable for any act or omission that occurred in breach of their duties. While this appears to offer wide protection to council members from liability, it is quite possible that in many cases where a breach is proven, a council member will not be able to establish that they acted in good faith.

18.01.2022 STRATA TENANTS: Being a strata tenant is similar to being an owner - in that you need to abide by the stratas by-laws and are entitled to certain consumer protections. By-laws are the rules that guide how the strata is run and also the conduct of all the people who own, live in and visit the strata property. As a tenant, you will now also be informed if a termination proposal has been made on the scheme you are living in, once WAs new strata law and regulations take effect.... What you need to know - By-laws affecting you as the tenant: Some of the by-laws which could affect you are set out in the Strata Titles Act 1985 and some might have been created specifically for your strata by the people owning all of the lots when the scheme was created. Its important that you have a copy of your strata scheme by-laws so that you understand whats expected of you and dont accidentally breach one of them. Breaking a by-law can result in a sizeable fine. Termination of the Scheme, proposals: You will be notified if you are a tenant in a strata scheme that has received a termination proposal. This means that the owners of the lots in the scheme are going to vote between two and six months on whether or not to sell. If the termination is referred to the State Administrative Tribunal (SAT) because there wasnt 100% agreement on the termination, then you will be kept informed of this. If SAT rules that the termination may go ahead it might also rule that you, as a tenant, be paid an extra amount for ending your tenancy early. If the termination is agreed to, then your residential tenancy might be cancelled under the Residential Tenancies Act 1987. If so, you must be given a reasonable time to move out.

07.01.2022 Under the new Strata Titles Amendment Act - Selling your strata lot will soon require you by law, to provide more information to a potential buyer before any contract is signed. This is to ensure buyers are well-informed on the strata lot and scheme they are purchasing. What you need to know: You will have to provide your real estate agent with the information listed below.... For the strata titles scheme: The scheme notice, scheme plan, scheme by-laws and schedule of unit entitlements for the strata titles scheme, For a leasehold scheme, the strata lease for the lot The minutes of the most recent Annual General Meeting and of any subsequent extraordinary general meetings of the strata company, The statement of accounts last prepared by the strata company, Information on any termination proposal that may have been put to the strata company, For the strata lot: Its exact location shown on the scheme plan for the strata titles scheme, Its definition, as contained in the scheme plan for the strata titles scheme, The unit entitlement of the lot, If contributions have been determined by the strata company within the previous 12 months, The amount and due date of the contributions payable by the lot owner or a reasonable estimate, Details of any debt owed by you to the strata company, including how the debt arose, the date on which it arose and the amount outstanding, If the lot is a special lot, details of the exclusive use by-laws that apply to the lot. This might look like a lot of information to gather, but almost all of it will be information you already have. The rest of it you can seek from the strata company or Strata Manager.

06.01.2022 COMMUNITY SCHEMES: Community Schemes are being introduced into Western Australia. They are a new option for subdividing a single parcel of freehold land into multiple community titles schemes that together are called a community scheme. Community schemes already exist in other states including New South Wales, South Australia and Queensland. In WA they will introduce new definitions, concepts, structures and processes.... Community schemes will not replace strata and survey-strata schemes which will still operate under the Strata Titles Act 1985. Strata and survey-strata schemes cannot be combined with community schemes. Community schemes will not include leasehold schemes. It is intended to introduce community schemes to Western Australia by new legislation, called the Community Titles Bill 2018. Development of community schemes: A community scheme will have one or more community titles schemes. Management of community schemes: A community scheme may have two or three tiers of community titles schemes and they will be managed as a hierarchy. Dispute resolution in community schemes: The State Administrative Tribunal (Tribunal) will be the one stop shop for resolving disputes between parties in community schemes if the parties have not been able to resolve the dispute themselves. Buyer information in community schemes: A buyer will be buying a property in a community titles scheme that is one of multiple schemes in the community scheme. Safeguards for the termination of community schemes: There is a process that must be followed to terminate a community scheme.
