20.01.2022 LACK OF INCOMING MIGRANTS DURING CORONAVIRUS IS WOUNDING AUSTRALIA'S HOUSING SECTOR A fall in migrants during the pandemic is causing a sharp drop in housing demand, with the sector urging the government to create a migration plan and extend HomeBuilder incentives. Scott Morrison is being urged to extend the HomeBuilder program after new research found the coronavirus pandemic could savagely cut housing demand over the next three years.... The Property Council also wants the government to introduce a new migration plan. Population growth could fall by 214,000 between 2019 and 2021, a decline only surpassed by World War I and the unwinding of the 1971 baby boom. This is the result of international border closures that have effectively shut down overseas migration, which accounts for roughly 60 per cent of population growth. As a consequence, housing demand could be cut by between 129,000 and 232,000 dwellings. The National Housing Finance and Investment Corporation has also highlighted the potential impact of international students from countries like India and Brazil no longer being able to travel. Evidence from the global financial crisis suggests economic factors such as the unemployment rate and the exchange rate are also important for international students in selecting Australia. 18.01.2022 ‘NO ENGLISH, NO PERMANENT RESIDENCY’: NEW RULES FOR AUSTRALIAN PARTNER VISAS FROM LATE 2021 Acting Immigration Minister Alan Tudge has said migrants and their permanent resident sponsors applying for a partner visa will be required to have functional-level English or will have to demonstrate that they have made reasonable efforts to learn the language from the middle of next year. The Morrison Government has revived its push for migrants to demonstrate English language skills... as they seek to maximise employment opportunities for new arrivals in a post-pandemic Australia. Minister Tudge said the English language skills will empower migrants and protect them against family violence and exploitation at work once they start to live in Australia permanently. We also know that without sufficient English language skills, migrants are particularly vulnerable to family violence and other exploitation and are less likely to know how and where to seek assistance, Minister Tudge said in a press release last month. When will this new requirement come into effect? The test which applies to both the applicant and their sponsor if they are a permanent resident rather than an Australian citizen will come into effect in late 2021. Minister Tudge said both the prospective applicants and their sponsors will be required to have "functional-level English" or to demonstrate that they have made "reasonable efforts to learn English". People will be able to demonstrate this through, for example, the completion of 500 hours of free English language classes through the Adult Migration English Program (AMEP), he said. 'No English, no permanent residency' It is important to point out that as per the new policy, applicants and sponsors will NOT be required to demonstrate their English language competency at the time of lodgement of a provisional visa (309/820) but will have to demonstrate it at the time of applying for a permanent visa (100/801). What is a ‘functional level’ of English? While the government has not yet revealed the criteria for the English language requirement for partner visas, here’s what ‘functional’ English language means as per the Department of Home Affairs website. In terms of language tests, a person’s English can be assessed as functional if they have scored an average band score of at least 4.5 based on the 4 test components in IELTS, an overall band score of at least 30 for each component in PTE, a total band score of at least 32 if they take TOEFL and an overall band score of at least 147 for each of the 4 components if they sit for CAE. 16.01.2022 NEW AUSTRALIAN CITIZENSHIP TEST FROM 15 NOVEMBER 2020 For the first time in over a decade the government has decided to revamp the citizenship test, adding questions that address national values. Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge has announced new changes to the citizenship test. This is the first time in more than a decade that Australia’s citizenship test is getting a new update. Mr Tudge said Our Austral...ian values are important. They have helped shape our country and they are the reason why so many people want to become Australian citizens. We are asking those who apply for citizenship to understand our values more deeply before they make the ultimate commitment to our nation, Tudge added. What exactly are the changes? The updated test will now include five multiple-choice questions addressing questions on ideas such as mutual respect, equality and democracy. Each applicant will be required to answer each of these new questions correctly, and to achieve at least 75% on the overall test. The test itself is made up of 20 multiple-choice questions, with the example test on the government’s website giving three options for each question. There won’t be any changes to English language or residency requirements for citizenship. What will the questions look like? Examples of the questions include: - Which of these statements best demonstrates Australian values about freedom of expression? - Why is it important that all Australian citizens vote to elect the state and federal parliament? - Should people in Australia make an effort to learn English? - In Australia, can you encourage violence against a person or group of people if you have been insulted? - Should people tolerate one another where they find that they disagree? - In Australia, are people free to choose who they marry or not marry? - In Australia, is it acceptable for a husband to be violent towards his wife if she has disobeyed or disrespected him? - Do you agree that men and women should be provided equality of opportunity when pursuing their goals and interests? - Should people’s freedom of speech and freedom of expression be respected in Australia? Impact of COVID-19 on the citizenship process: Due to COVID-19, citizenship ceremony will be delivered online via video-link. However, in some states, in-person citizenship appointments and tests are resuming. DoHA will contact applicants regarding the citizenship appointment and the test. According to Tudge, more than 85,000 people from every state and territory have become Australian citizens in online ceremonies since the onset of the coronavirus pandemic. 15.01.2022 FURTHER CHANGES TO SUPPORT FAMILY VISA APPLICANTS The following email has been received today: The Morrison Government is making further changes to the Family visa program to support applicants impacted by the COVID-19 pandemic. ... The Government has been working over recent months to minimise the impact of COVID-19 on visa holders and has already introduced a number of arrangements to support those who have been impacted. This includes providing visa holders flexibility to remain in Australia, or to continue their visa pathway even if they have been unable to travel due to the current international border restrictions. In addition to these changes, the Government will allow certain Family visas which have been applied for outside Australia, to be granted while the visa applicant is in Australia. This temporary concession will be for people who are in Australia and are not able to travel offshore to be granted the visa due to COVID-19 related border closures. The Government estimates the change will benefit about 4000 visa applicants currently in Australia, predominately Partner applicants. Acting Minister for Immigration, Citizenship, Migrant Services and Multicultural Affairs Alan Tudge said the changes would be temporary and will be reviewed in line with any changes to Australia’s international travel restrictions. These are common sense changes to reduce the impact that the travel restrictions are having on our immigration program, Mr Tudge said. Importantly, this will allow a foreign national who is a partner of an Australian citizen to progress their visa, without having to leave the country. I know this will be a relief to those Australians who were concerned that their loved one may have to leave the country with no certainty as to when they could return. These changes are in addition to the Government’s decision to almost double the number of Partner visa places in 2020-21. It is expected that three quarters of these visas will go to those already onshore, with the increase in numbers addressing nearly all the present applicants awaiting for finalisation of their visa. 12.01.2022 GOVERNMENT APPROVES PILOT TRIAL TO BRING BACK INTERNATIONAL STUDENTS Flinders University has confirmed that the Federal Government has approved to bring 300 international students into Adelaide. Under the new pilot scheme aiming to reboot international education, the approval allows 300 continuing students to come back to Adelaide. It is anticipated that the majority of the students will be flying in from Singapore and their arrival is expected to happen in November.... A further 70 students are expected in Darwin in the next month under a similar arrangement into Charles Darwin University. Under the second pilot, which has the approval of the Australian and Northern Territory governments, will see up to 70 international students arrive in Darwin from Singapore in late October in time for the next CDU intake on 9 November. The group will be the first international students to enter Australia since the introduction of hard border restrictions in March due to COVID-19. Upon arrival, students will be escorted immediately to the Northern Territory Government facility at Howard Springs for 14 days of quarantine. CDU Deputy Vice-Chancellor Global Strategy and Advancement, Andrew Everett said his team had been working tirelessly over the past six months to secure the return of the students and wanted to reassure the Darwin community that all health and safety measures will be strictly maintained as directed by the Chief Health Officer of the NT. 11.01.2022 PTE CONCORDANCE REPORT Pearson PTE has recently released a report that has reassessed the concordance between PTE English language scores and those of the IELTS scores. PTE has adjusted some scores to better align with the IELTS standard scores. Those who are aiming for 20 points for migration scoring 79 in each band in PTE (equivalent to 8 in each band in IELTS) will need to score 84. However for people aiming for 50 in PTE (equivalent to 6 in IELTS), they will only need to ...score 46. These changes have been reported to the Governments of Australia, New Zealand and the United Kingdom, all of who accept PTE English language tests for migration purposes. However, until a new legislative instrument is released on changing the scores, the currently legislated scores will remain in force. Nevertheless, the MIA would not expect retrospective changes to the scores for applications lodged before any changes are implemented. 09.01.2022 GOVERNMENT ANNOUNCES FURTHER DETAILS ABOUT VISA APPLICATION CHARGE CHANGES, WAIVERS AND REFUNDS The Australian government today announced further details about various changes to visa application charges, waivers and refunds related to people impacted by COVID-19, including the following statements: Visitors... Visitor visa holders who are overseas and whose visas expired or will expire between March 2020 and December 2021 will be eligible for a waiver when they apply for a new visa. Working holiday makers Backpackers on Working Holiday Maker visas who have been unable to come to Australia or who had to leave Australia early due to COVID-19 will also be eligible for a waiver, when they decide to return to Australia. Those who are unable to return because they have passed the age limit for a Working Holiday Maker visa will be able to claim a refund. Seasonal Worker Program and Pacific Labour Scheme workers Seasonal Worker Program and Pacific Labour Scheme visa holders will also be eligible for a refund of the VAC if they were granted a visa before 20 March 2020 and have been unable to travel to Australia due to COVID19 Temporary skilled workers Due to travel restrictions there are many Temporary Skill Shortage and Temporary Work (Skilled) visa holders who have not made their initial entry to Australia, or have returned home due to COVID-19 and may wish to apply again. To support local businesses that seek to access critical skills not available in the local labour workforce, the Government will offer a waiver of the VAC for subsequent applications by affected temporary employer sponsored skilled migrants. Prospective Marriage visa holders The Prospective Marriage visa provides holders with nine months to travel to Australia to marry an Australian citizen or permanent resident. VAC refunds will be available for Prospective Marriage visa holders who have been unable to enter Australia before their visa expired, due to COVID-19 related travel restrictions. Refunds will ensure these visa holders are able to apply for another visa to travel to Australia and hold their wedding once travel restrictions are lifted. For those visas that have already expired, any new application will be prioritised. Visa extensions will be available for Prospective Marriage visa holders whose visas are still valid. 05.01.2022 AUSTRALIA'S INTAKE OF PERMANENT MIGRANTS HAS DROPPED TO ITS LOWEST LEVEL IN 10 YEARS New figures reveal the coronavirus pandemic is steeply driving down the number of permanent visas being approved for migrants. Australia’s permanent migration intake has fallen to its lowest level in at least 10 years as the coronavirus pandemic causes visa processing delays and major disruptions to international travel. ... New figures reveal the number of permanent visa approvals reached 140,366 in the 2019/20 financial year to 30 June. The number of approvals falls well below the government's planning ceiling of 160,000, and is down from the 10-year average of 175,000 permanent visas each year. By comparison, there were some 160,000 permanent visas issued in the last financial year before the coronavirus pandemic. The latest figures showed 90,499 people had their visas approved while they were in Australia, compared to 84,260 the previous year. The new figures showed 70 per cent of permanent pathway visas had been granted through the skilled stream. 2 weeks ago, the government announced a new priority skill list to lure specific temporary migrants to Australia, including nurses, doctors, construction managers and software engineers. Those who fall under the 17 designated categories will be prioritised for a travel exemption allowing them to enter Australia, but will still be required to complete the 14-day supervised quarantine at their own expense. 05.01.2022 NEW TRAVEL EXEMPTION ADDED FOR AUSTRALIANS LEAVING AUSTRALIA Due to COVID-19, the government has put in place strict border measures to protect the health of the Australian community. There are travel restrictions in place and Australian citizens and permanent residents are only allowed to travel in limited circumstances. A new travel exemption has been added recently to the below list. If you are travelling outside Australia for three months or longer, you are eligible to ap...ply for an exemption. You can also apply for a travel exemption on one of the following grounds: your travel is as part of the response to the COVID-19 outbreak, including the provision of aid your travel is essential for your business/employer you are travelling to receive urgent medical treatment that is not available in Australia you are travelling on compassionate or humanitarian grounds your travel is in the national interest. You can apply for the exemption online. To apply, you must provide evidence to substantiate your claim. You may need to provide the following documents: passport/s marriage certificate/s birth certificate/s death certificate/s proof of relationship (for example, shared tenancy agreement, joint bank account etc.)* proof that you are moving to another country on a long term basis such as leases, job offers and evidence your goods are being transported proof of your current valid visa, including in Australia and/or overseas letter from a doctor or hospital about any medical treatment/condition with statements on why travel is necessary letter from your employer, or other evidence that you are travelling for an essential business reason statement or evidence to show when you wish to return to Australia any other proof you may have to support your claims.
