25.01.2022 One day our client Mark came home from a work trip to find that his partner had left with the children and re-located in another state. Mark knew nothing about this until he came home to an empty house. After attempts to locate his children, Mark was finally referred to Rafton Family Lawyers by a friend. Our team were successful in obtaining a Commonwealth location order which allowed us to locate the mother and serve her with documents to appear in court over the phone.... During the settlement, we were able to negotiate for Mark to spend time with his children. It was also arranged that Mark would be notified of any future changes to the mother’s address or phone number within 7 days of the change occurring. If you or someone you know needs legal advice to sort out a complicated family matter, please share this story or contact us on 1300 4326 459 for more information.

24.01.2022 Case Study One of the most important parts of our work is helping parents make the best choices for their children. Breaking up is hard, breaking up with children involved is (almost always) ten times harder. Christine is one of the many parents we have been able to help with parenting disputes. ... Christine and her ex couldn’t come up with a solution that worked for everyone. It’s often too hard to sort out parenting issues when the break up is fresh and sensitive. That’s where mediation comes in. Mediation doesn’t mean you and your ex have failed as parents. It’s one of the best things you can do to communicate well when things are the most stressful. It’s a lot cheaper to get help to reach an agreement than it is to go to court, and it’s much less stressful for the kids. Christine and her ex were able to reach an agreement after a 3-hour conference which we then turned into a legal document. What could have been thousands of dollars and months in court was resolved in just 3 hours of mediation. If you’d like to know more about mediation, call our Sydney office on 1300 4 FAMILY (326459).

22.01.2022 Child support can be confusing and complicated. Did you know that there are options available to enter into an agreement with your ex partner rather than via the child support agency. Call us now to book a no obligation consultation and discuss your options. 1300 4 FAMILY [email protected]

17.01.2022 4% of Australians say they don’t want one. 14% say they don’t have enough assets (what about your superannuation?). 34% want a will, but don’t have one, because they keep putting it off.... Does that sound familiar? Well, today is the day to sort it out! Put it on your to-do list. Write it somewhere where you’ll see it every day. Let that note annoy you until you TAKE ACTION. And of course, we are here to help. Book an appointment with us today and never worry about your will (or lack of will) again.

15.01.2022 1. Every state in Australia has different rules about contesting a will, so if you contest a will make sure you do it in your state. 2. In NSW, you can apply to the Supreme Court for a family provisions claim if you have been left out of or poorly provided for in a will. 3. You must be an eligible person to contest a will. This means you are: - A former spouse, current spouse or de-facto partner of the deceased - Their child... - At least partly dependant on the deceased - Their grandchild - A member of the deceased’s household 4. You must make a claim within 12 months of the death of the deceased. 5. Contact our professional family law solicitors on 1300 4326 459 for personalised advice! See more

08.01.2022 This means that property, child maintenance and your superannuation will be treated the same as if you were married. So, what makes a relationship de-facto anyway? Generally, a relationship becomes de-facto when a couple has lived together for 2 years, but some things can make your relationship de-facto even before this 2-year mark, like having children.... A person can be in a de-facto relationship even if they are legally married to someone else. Why do you need to know about this? Because sometimes people don’t realise that their relationship has become de-facto and that there are laws determining what will happen if your relationship ends, or if your partner dies. Have you got questions about your relationship (apart from why does he put the clothes next to the washing basket?). Give us a call on 1300 4 FAMILY (326459), we’re always happy to help!

08.01.2022 Sadly, victims of abuse often report that their abuser threatens their pets as a form of manipulation, intimidation, and coercion. The government is responding to this by reforming current Apprehended Domestic Violence Orders to include laws regarding animal cruelty. The new law means that anyone who threatens or abuses an animal in the context of a domestic relationship can receive charges for animal cruelty as well as domestic violence. The bill will be passed in NSW parlia...ment this week in hopes it will help victims flee violent homes more easily and protect their pets. As well as this, the NSW Government has invested $500,000 into a new program to house animals of domestic violence victims. The Funds from the PAWS program will go towards making refuges animal-friendly and helping animal shelters house pets while their owners find safe accommodation. You can apply for the paws program via this link: https://www.dcj.nsw.gov.au/dfv-paws If you need help leaving a situation of domestic violence, please contact our head office on 02 4578 5611 or call 1300 4 FAMILY.

06.01.2022 Case Study Two years after his separation, David and his ex could not resolve their property settlement. David moved out: his ex stayed in the house with the kids.... By the time David came to us, he had been with another law firm for over 18 months with no results. The other party simply refused to respond to all efforts to negotiate. We managed to make contact with the other party and file an application at the court, but they still refused to negotiate. They didn’t start to participate until 3 months after the court proceedings when the matter was referred to arbitration. The outcome was successful for David. He was extremely pleased that the matter was resolved within 8 months after 18 months of work and no results with his previous lawyers. David has now been able to purchase a new house with the funds he received from the settlement. We have a lot of experience with arbitrations in property settlements. Give us a call on 1300 4 FAMILY (326459) if you’d like to know more.

05.01.2022 Our client Susan was having trouble with her property settlement. Her former husband was refusing to negotiate and wouldn’t move out of the house. It was estimated that the matter would be delayed in court for 18 months to 2 years before there could be a 1-2 day trial. We were able to obtain an arbitration award within three months of our application which had an excellent outcome for Susan. We were also successful in an application for costs against the husband for Susan’s a...rbitration and solicitors fees. Our team have a lot of experience with arbitrations and property settlements. If you would like more information, please contact our offices on 1300 4326 459.

03.01.2022 The Specialist Accreditation Scheme helps people identify solicitors who are experts in a particular area. This accreditation only goes to solicitors who have extensive experience in that area of law and who pass the Law Societies rigorous examination and assessment program. These solicitors must also upskill themselves to the highest standard every year.... Whenever you see the accredited specialist’s logo next to a solicitors name, you know that they have been trained to the highest possible standard in their field. Kate Rafton is an accredited specialist in both family and children’s law, which means that your family matter is in the best hands possible. Contact us today on 1300 4326 459 about any family matter you are facing, and we will give you our expert advice.
