23.01.2022 Last year on 29th November 2019, the Supreme Court of New South Wales delivered its judgment on the Queensland Floods Class action in favour of the plaintiff and group members. Prior to the court handing down its decision, it was widely reported to be the largest ever class action in Australia with the bill estimated to be about $1 billion. However realistically, the victims may not get their payouts until 2021 a decade on from the disaster. Both Sunwater and Seqwater, whi...ch were found partly responsible for water damage to almost 7000 homes, have confirmed they will appeal the NSW Supreme Court finding. Former Ipswich councillor and flood class action claimant Paul Tully said the appeal process will add to the distress victims have experienced over "nine long and tortuous years. These insurance companies are toying with people's lives and futures," he said in a statement. "They are corporate scumbags just delaying the inevitable. They make Scrooge look like an honourable citizen." The matter is scheduled to return to court on April 29 for further case management. 18.01.2022 In the wake of the COVID-19 pandemic, many organisations are considering whether they can hold general meetings using technology, or if they need to instead delay upcoming meetings. The Federal Treasurer has provided short-term regulatory relief from provisions relating to company meetings under the Corporations Act 2001 (Cth). The Corporations (Coronavirus Economic Response) Determination (No. 1) 2020 (Cth) enables companies to hold annual general meeting (AGMs), and other m...eetings prescribed under the Corporations Act, entirely electronically. The legislative instrument commenced on 6 May 2020 and is expected to remain in place until 21 March 2020, following a recent announcement from the Treasurer. Unfortunately, the Determination provides minimal relief to companies that are registered charities. Further to this, the Associations Incorporation Act has recently been amended to allow incorporated associations to hold meetings, or permit members to take part in its meetings, by using any technology that reasonably allows members to hear and take part in discussions as they happen. 10.01.2022 The Queensland Parliament has passed legislation that will remove the current licence exemption that allows unlicensed persons to contract for commercial building work so long as they use an appropriately licensed contractor to carry out that work. Developers and head contractors who tender for, or contract to carry out, building work will be required to hold the appropriate licences for the building work falling within the scope of the contract regardless of whether the work... is to be performed by licenced subcontractors, or else contravene the QBCC Act. However, the drafting of the exemption has in recent years been increasingly relied upon by unlicensed contractors. This has been criticised by various quarters of the industry as an outcome which undermines the licensing regime and restricts the ability of the QBCC to take action against those persons in the event of defective work and for behaviour which licensed contractors are prohibited from engaging in. With today's increased focus on licensing and enforcement, developers are unlikely to escape attention from the QBCC. 08.01.2022 Australian Consumer Law has redefined "consumer" as a party that purchases goods or services in the monetary threshold of $40,000 will increase to $100,000. Businesses that supply goods or services to end-customers up to $100k will need to know what legal obligations they must comply with under the ACL. One of them is that a supplier must comply with the mandatory guarantees in relation to the consumers. A warranty against defects is a representation or promise by a supplier... to a consumer that if goods or services are defective, the supplier will repair or replace the goods, resupply or fix the problem or provide compensation. Increasing the monetary threshold to $100k means a vast array of large commercial transactions that were previously not subject to the ACL will be subject to the consumer guarantees regime and express warranties against defects requirements from 1 July 2021. 07.01.2022 Big changes to Victoria come as all Victorian employers are to notify WorkSafe Victoria when they become aware that an employee or independent contractor has been diagnosed with COVID-19. A failure to notify WorkSafe will attract a penalty of up to $39,652 for individuals and $198,264 for a body corporate. The 'infectious period' is the period from 14 days prior to receiving the confirmed diagnosis of COVID-19, until clearance from isolation has been received. A broad range o...f industries and sectors will now be required to close their workplaces or significantly reduce their capacity, but this does not change an employer’s requirement to notify WorkSafe if a confirmed case occurs. The new Regulations extend the operation of Part 5 of the Victorian Occupational Health and Safety Act 2004 (OHS Act) as previously, employers were not required to report an infectious disease in the workplace, unless immediate inpatient treatment was required or the disease was the cause (or suspected cause) of a death.
