22.01.2022 Australian Consumer Law has redefined "consumer" as a party that purchases goods or services in the monetary threshold of $40,000 will increase to $100,000. Businesses that supply goods or services to end-customers up to $100k will need to know what legal obligations they must comply with under the ACL. One of them is that a supplier must comply with the mandatory guarantees in relation to the consumers. A warranty against defects is a representation or promise by a supplier... to a consumer that if goods or services are defective, the supplier will repair or replace the goods, resupply or fix the problem or provide compensation. 21.01.2022 A recent case, Moore v Scenic Tours Pty Ltd [2020] HCA 17, could have significant ramifications for the Australian tourism industry. The Moores booked a European holiday with Australian-based tour operator Scenic Tours, including a cruise. However, the cruise only proceeded for three of the 10 scheduled days due to adverse weather. Mr Moore argued that Scenic knew, or should have known, about the weather disruptions that were likely to occur, and failed to inform passengers o...r give them the opportunity to cancel their booking. We would urge a cautious approach when making use of electronic communication and signatures in entering into corporate contracts. Because the circumstances will necessitate parties entering into contracts without necessarily having face to face... contact, there needs to be increased scrutiny when entering into contracts to ensure that the correct person has affixed their electronic signature. Companies also need to consider whether they are prepared to accept a document from their counterparty which has been executed electronically, or has been executed by one party in separate counterparts. The plaintiff had slipped at night on back stairs that were worn, slippery and unlit with no handrail. Yeung had breached his inspection obligation as owner and failed to identify the obvious defect in the stairs but he had delegated wholly his inspection obligation to Santosa, the managing agent, which Santosa... had failed to carry out. For professional liability insurers of managing agents and property managers, the decision illustrates the high exposures they face. These professionals assume a range of duties on behalf of owners. It is commonplace nowadays that any person injured on residential or commercial premises will sue both the owner and the managing agent. It is therefore critical for a managing agent or property manager to perform the inspection duties they contracted to provide with the appropriate level of diligence and document their findings (now often with photographs). The DIN regime has been introduced to promote good corporate conduct and combat illegal phoenixing activity. Illegal phoenixing involves deliberately avoiding paying liabilities by shutting down an indebted company and transferring its assets to another company. Criminal and civil penalties apply to anyone found in breach of their obligations under the DIN regime..., with the maximum civil penalty being the greater of A$10.5 million (50,000 penalty units). Broadly, there are four key obligations under the DIN regime. Persons must: 1. apply for a DIN prior to being appointed as a director or within a prescribed period of being directed to do so by the registrar (being 28 days if not specified in the registrars direction); 2. not knowingly apply for multiple DINs; 3. not deliberately provide false identity information to the registrar; and 4. not misrepresent a DIN to a government body or registered body. Under the Paid Parental Leave Act 2010, eligible new parents can take up to 18 weeks leave, funded by the Federal Government and paid at the rate of the national minimum wage. 13.01.2022 How many times have you come across someone passing off an inappropriate comment or action as a "joke"? A commonplace for this is in the workplace. An example of this is in a recent case Emmanuel Montes v The Star Casino [2020] FWC 874 where Montes, employee of Star Casino took a joke too far when he grabbed a tray and smacked a female employee on the bottom. Casino Star dismissed him for his responses to the complaints made against him, the relevant company policies, and n...o regard to the written warning. Mr Montes showed no remorse and felt that The Star Casino unfairly dismissed him. However, the Fair Work Commission (FWC) ruled in favour of Star Casinos decision to terminate the employee as the physical contact he engaged in was highly inappropriate and amounted to sexual harassment. 08.01.2022 Big changes to Victoria come as all Victorian employers are to notify WorkSafe Victoria when they become aware that an employee or independent contractor has been diagnosed with COVID-19. A failure to notify WorkSafe will attract a penalty of up to $39,652 for individuals and $198,264 for a body corporate. The infectious period is the period from 14 days prior to receiving the confirmed diagnosis of COVID-19, until clearance from isolation has been received. A broad range o...f industries and sectors will now be required to close their workplaces or significantly reduce their capacity, but this does not change an employers requirement to notify WorkSafe if a confirmed case occurs. The new Regulations extend the operation of Part 5 of the Victorian Occupational Health and Safety Act 2004 (OHS Act) as previously, employers were not required to report an infectious disease in the workplace, unless immediate inpatient treatment was required or the disease was the cause (or suspected cause) of a death.
