23.01.2022 If youre going to be a parent in 2020, read on. Under the Paid Parental Leave Act 2010, eligible new parents can take up to 18 weeks leave, funded by the Federal Government and paid at the rate of the national minimum wage. Currently to qualify for PPL, a parent must have worked a minimum of 330 hours in 10 of the 13 months prior to the birth, with no more than an eight-week break between two working days. The Government will now extend the break between working days from e...ight to 12 weeks and allow women to move their work test period if they have had to stop work early due to a workplace hazard. This will apply to parents of children born or adopted on or after January 1. Paid parental leave currently has to be claimed in an 18-week chunk Other changes include families having greater flexibility with how they use paid parental leave entitlements under a Coalition plan, amid concerns the existing program is too rigid and not being fully utilised. 23.01.2022 Australian Consumer Law has redefined "consumer" as a party that purchases goods or services in the monetary threshold of $40,000 will increase to $100,000. Businesses that supply goods or services to end-customers up to $100k will need to know what legal obligations they must comply with under the ACL. One of them is that a supplier must comply with the mandatory guarantees in relation to the consumers. A warranty against defects is a representation or promise by a supplier... to a consumer that if goods or services are defective, the supplier will repair or replace the goods, resupply or fix the problem or provide compensation. Increasing the monetary threshold to $100k means a vast array of large commercial transactions that were previously not subject to the ACL will be subject to the consumer guarantees regime and express warranties against defects requirements from 1 July 2021. Are you classified as a consumer under the ACLs new definition? #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate Credit: VSGL / Johnson Winter & Slattery

22.01.2022 Australia will require directors to be registered and assigned with a unique Director Identification Number (DIN). The DIN regime has been introduced to promote good corporate conduct and combat illegal phoenixing activity. Illegal phoenixing involves deliberately avoiding paying liabilities by shutting down an indebted company and transferring its assets to another company. Criminal and civil penalties apply to anyone found in breach of their obligations under the DIN regime..., with the maximum civil penalty being the greater of A$10.5 million (50,000 penalty units). Broadly, there are four key obligations under the DIN regime. Persons must: 1. apply for a DIN prior to being appointed as a director or within a prescribed period of being directed to do so by the registrar (being 28 days if not specified in the registrars direction); 2. not knowingly apply for multiple DINs; 3. not deliberately provide false identity information to the registrar; and 4. not misrepresent a DIN to a government body or registered body. 22.01.2022 Ask any local about one of the founding fathers of Toowoomba and you’ll invariably get the same response: The bloke who built the Royal Bull’s Head Inn! The inn was originally William Horton’s popular hotel in Drayton. However, the ex-convict’s business was so successful that in 1859 it was expanded into the Royal Bull’s Head Inn, which is still standing and open to visitors to this day. You’ll struggle to find anywhere in the Darling Downs with as much historical significance as Horton’s inn so much so that it’s been in the hands of the National Trust of Queensland for more than four decades. Horton also started the first horse races in Queensland. Credit: Remax

19.01.2022 Yeung v Santosa Realty Co Pty Ltd [No 2] [2020] VSCA 29 illustrates the high exposures managing agents and property managers face in respect to defects causing injury. The plaintiff had slipped at night on back stairs that were worn, slippery and unlit with no handrail. Yeung had breached his inspection obligation as owner and failed to identify the obvious defect in the stairs but he had delegated wholly his inspection obligation to Santosa, the managing agent, which Santosa... had failed to carry out. For professional liability insurers of managing agents and property managers, the decision illustrates the high exposures they face. These professionals assume a range of duties on behalf of owners. It is commonplace nowadays that any person injured on residential or commercial premises will sue both the owner and the managing agent. It is therefore critical for a managing agent or property manager to perform the inspection duties they contracted to provide with the appropriate level of diligence and document their findings (now often with photographs). We also think it is important to regularly report to owners about the state of the premises so that an owner is on notice about any actual or potential deficiencies that may expose both owner and managing agent to liability. 18.01.2022 Top Five Tips for Preparing to Sell your Business 1. Assemble a great team: Building a supportive team around you to assist with the sale will be vital. This will involve assembling a team of legal, financial and tax advisors to guide you through the transaction. 2. Be prepared: You should ensure that your business has well documented financials, contracts with employees, contracts with suppliers and contracts with customers. Having properly documented arrangements with key s...takeholders in the business will add value to the business in the eyes of potential buyers. 3. Be mindful during negotiations: The terms on which you sell your business will materially affect the ultimate value of the transaction to you. It is important that you do not only focus on the price during negotiations as there are other terms that could affect what you take away from the transaction. 4. Be aware of tax implications: Selling your business will likely have capital gains tax consequences and you should consider the potential tax implications prior to entering into a sale agreement. 5. Prepare for settlement: Once the transaction terms have been finalised it is necessary to turn your mind to the settlement process. The better prepared you are for settlement, the smoother and easier the process will be. #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate Photo Credit: Consonant Marketing

16.01.2022 How many times have you come across someone passing off an inappropriate comment or action as a "joke"? A commonplace for this is in the workplace. An example of this is in a recent case Emmanuel Montes v The Star Casino [2020] FWC 874 where Montes, employee of Star Casino took a joke too far when he grabbed a tray and smacked a female employee on the bottom. Casino Star dismissed him for his responses to the complaints made against him, the relevant company policies, and n...o regard to the written warning. Mr Montes showed no remorse and felt that The Star Casino unfairly dismissed him. However, the Fair Work Commission (FWC) ruled in favour of Star Casinos decision to terminate the employee as the physical contact he engaged in was highly inappropriate and amounted to sexual harassment. Always remember that there is zero tolerance towards sexual harassment and employers have the right to dismiss an employee if he/she has engaged in serious misconduct. #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate #sexualharassment Photo Credit: Vox

15.01.2022 The Queensland Parliament has passed legislation that will remove the current licence exemption that allows unlicensed persons to contract for commercial building work so long as they use an appropriately licensed contractor to carry out that work. Developers and head contractors who tender for, or contract to carry out, building work will be required to hold the appropriate licences for the building work falling within the scope of the contract regardless of whether the work... is to be performed by licenced subcontractors, or else contravene the QBCC Act. However, the drafting of the exemption has in recent years been increasingly relied upon by unlicensed contractors. This has been criticised by various quarters of the industry as an outcome which undermines the licensing regime and restricts the ability of the QBCC to take action against those persons in the event of defective work and for behaviour which licensed contractors are prohibited from engaging in. With todays increased focus on licensing and enforcement, developers are unlikely to escape attention from the QBCC. 14.01.2022 Made a donation to a charity or thinking about it? Read on. Be sure to do your research to find out which organisation your money will be given to and how it is planning to use it. Your research should cover at the very least: the stated purpose and activities of the organisation;... the values of the organisation; if your donation is to support a specific initiative, how much the organisation has already raised for that initiative; if someone is raising funds on behalf of the organisation, whether that person has been properly authorised to do so and does that person, or the fundraising platform they are using, receive any financial or other benefit for conducting the fundraising; and if you would like a tax deduction, whether the organisation is a DGR. While most people will give from the goodness of their heart and their commitment to the cause or the individuals behind it, whether a donation is tax deductible may influence a donors decision to give. Remember just because an organisation or fund is registered as a charity with the ACNC, doesnt mean you can claim a tax deduction for your donation. Remember, charities and not-for-profit organisations often depend on your generous donations to continue to do what they do and to make positive change for individuals, communities, society and the environment. Many organisations would close overnight if donations were to dry up all of a sudden. So, yes, do give. Giving is such a human thing to do, but give wisely. #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate Photo Credit: Vox

13.01.2022 Here are the main commercial leasing principles included in the National Cabinet Mandatory Code of Conduct (Code) that apply due to the COVID-19 pandemic: Landlords must not terminate leases due to non-payment of rent during the COVID-19 pandemic period (or reasonable subsequent recovery period) Landlords must offer tenants proportionate reductions in rent payable in the form of waivers and deferrals of up to 100% of the amount ordinarily payable, on a case by case basis..., based on the reduction in the tenants trade during the COVID-19 pandemic period and a subsequent reasonable recovery period. The tenant should be provided with an opportunity to extend its lease for an equivalent period of the rent waiver and/or deferral period agreed to provide the tenant additional time to trade, on existing lease terms, during the recovery period after the COVID-19 pandemic period concludes. Landlords agree to a freeze on rent increases (except for retail leases based on turnover rent) for the duration of the COVID-19 pandemic and a reasonable subsequent recovery period, notwithstanding any arrangements between the landlord and the tenant. Landlords may not apply any prohibition or levy any penalties if tenants reduce opening hours or cease to trade due to the COVID-19 pandemic. 10.01.2022 Toowoomba Court House is a heritage-listed former courthouse at 46 Neil Street, Toowoomba, Queensland, Australia. The place is important in demonstrating the evolution or pattern of Queensland's history. It was designed by Francis Drummond Greville Stanley and built from 1876 to 1943. The courthouse was sold in 2000 to Robert and Lorraine Grant for use as a private residence and, with advice from the Queensland Heritage Council, undertook significant work consistent with the ...building's historic structure. In May 1979, a number of Queensland Government departments then occupied the building, including the Queensland Police, the Department of Sport and Tourism and the Department of Family Services. #toowoomba #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate Credit: Wikipedia

10.01.2022 Big changes to Victoria come as all Victorian employers are to notify WorkSafe Victoria when they become aware that an employee or independent contractor has been diagnosed with COVID-19. A failure to notify WorkSafe will attract a penalty of up to $39,652 for individuals and $198,264 for a body corporate. The infectious period is the period from 14 days prior to receiving the confirmed diagnosis of COVID-19, until clearance from isolation has been received. A broad range o...f industries and sectors will now be required to close their workplaces or significantly reduce their capacity, but this does not change an employers requirement to notify WorkSafe if a confirmed case occurs. The new Regulations extend the operation of Part 5 of the Victorian Occupational Health and Safety Act 2004 (OHS Act) as previously, employers were not required to report an infectious disease in the workplace, unless immediate inpatient treatment was required or the disease was the cause (or suspected cause) of a death. 07.01.2022 Under current work from home arrangements due to Covid-19, it may not be possible for signatories to sign documents in wet-ink (or via modified split execution) an electronic signature may be the only way the document can be signed. We would urge a cautious approach when making use of electronic communication and signatures in entering into corporate contracts. Because the circumstances will necessitate parties entering into contracts without necessarily having face to face... contact, there needs to be increased scrutiny when entering into contracts to ensure that the correct person has affixed their electronic signature. Companies also need to consider whether they are prepared to accept a document from their counterparty which has been executed electronically, or has been executed by one party in separate counterparts. If you are in doubt as to the validity of documents previously executed, in light of the issues address in Pickard, we recommend that you undertake an internal audit of all agreements executed pursuant to s 127 and if you have concerns as to their enforceability, seek legal advice. 07.01.2022 Popularly known as the 'King of Toowoomba', James Taylor was a founding settler. Early in the sixties Mr. Taylor took up his permanent residence in Toowoomba, and for more than thirty years he has been a prominent personality in the local history of the town. Toowoomba was virtually Taylor's creation. Perceiving advantages in the 'swamp' with its key position he succeeded in replacing Drayton with Toowoomba as the regional centre of the Downs. Mayor of Toowoomba in 1890, he h...eld much central real estate which was enhanced in value by judicious public works expenditure and private pressures. Taylor had superb management and development of Cecil Plains, and his role as the founding father of Toowoomba, had a wider impact on Queensland business. He has identified himself at one time or other with all our social institutions like the School of Arts, the Queensland Turf Club, the Royal Agricultural Society, the Queensland Club, the Brisbane Diocesan Synod and has rendered great assistance in the development of the place. #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate #trc #toowoombareigon #tlcfortrc #richtraditionsboldambitions #jamestaylor #toowoombahistory Credit: ADB

06.01.2022 Details have been announced of the commercial leasing principles that are to apply during the COVID-19 pandemic and which are included in the National Cabinet Mandatory Code of Conduct (Code). The Code applies to all commercial tenancies (including retail, office and industrial) where the tenant has signed up to the JobKeeper Program and that have an annual turnover of $50 million per annum or less. To the extent it applies to their leasing arrangement, the Code now imposes a... mandatory set of principles requiring landlords and tenants to renegotiate the terms and conditions of their leases to take into account the impact of tenant turnover caused by the economic impacts of industry and government responses to Covid-19. 06.01.2022 The first thing to understand is that the Privacy Act 1988 does not apply to individuals that operate drones because they are not a government agency. The second thing is that although the Civil Aviation Safety Authority might be a regulator, they do not regulate drones that invade privacy. Some actions by drone operators can be considered criminal offences. For example, in Queensland it is illegal to record somebody without their consent if they are in a private place or con...ducting a private act. There are many drone rules to follow like: flying only during the day only fly one drone at a time must not fly closer than 30 m to people other than those helping to fly or navigate your drone For more drone rules visit the CASA website https://www.casa.gov.au/drones/rules/drone-safety-rules Remember that you can report any unsafe drone activity to either the police or CASA. 04.01.2022 Woolies is in a bit of trouble with the Australian Communications and Media Authority (ACMA). Woolworths Group Limited sent 5 million spam emails in a major breach of the Spam Act 2003. Woolworths blamed technical and systems issues for its failure to process unsubscribe requests, which meant those marketing emails were sent as spam. The $1,003,800 fine is the largest ever issued by the ACMA. Any business that either encouraged or allowed their digital marketing team to con...tinue to operate campaigns that did not comply with the Spam Act 2003 is deserving of the penalty. The lesson for all business owners, regardless of the size of the business is to obtain independent, expert advice about the Spam Act 2003, ensure the obligations are understood and implemented into policy and procedure documents, including scheduled audits to ensure compliance. #woolies #woolworths #australia #rangelawyers #law #lawyer #conveyancing #corporatelaw #commercialaw #constructionlaw #familylaw #realestate Credit: Cordato Partners

04.01.2022 A recent case, Moore v Scenic Tours Pty Ltd [2020] HCA 17, could have significant ramifications for the Australian tourism industry. The Moores booked a European holiday with Australian-based tour operator Scenic Tours, including a cruise. However, the cruise only proceeded for three of the 10 scheduled days due to adverse weather. Mr Moore argued that Scenic knew, or should have known, about the weather disruptions that were likely to occur, and failed to inform passengers o...r give them the opportunity to cancel their booking. As a result, Mr Moore claimed damages for the difference in value between the service he paid for and the service received, and damages for his disappointment and distress. This decision sends a clear message that travel operators must comply with their obligations under the Australian Consumer Law, or risk being held liable if a consumer brings a claim. 01.01.2022 The world we live in now has constant new arrivals in technology. Here are 5 tips on how you can manage your privacy online. 1. Check how your personal information will be used - do you know everything you are signing up for? 2. Secure your computer or mobile device - install reputable security software, use a firewall, etc. ... 3. Avoid conducting sensitive transactions, such as online banking, when using public wi-fi hotspots 4. Protect your passwords - did you know it takes under 3 minutes for a hacker to crack the average password. Use different passwords for different sites, avoid using the ‘remember my password’ option. 5. Clean Public Computers’ Caches - If you use a public computer, make sure to clear the browser's cache when you are finished using it. 01.01.2022 Last year on 29th November 2019, the Supreme Court of New South Wales delivered its judgment on the Queensland Floods Class action in favour of the plaintiff and group members. Prior to the court handing down its decision, it was widely reported to be the largest ever class action in Australia with the bill estimated to be about $1 billion. However realistically, the victims may not get their payouts until 2021 a decade on from the disaster. Both Sunwater and Seqwater, whi...ch were found partly responsible for water damage to almost 7000 homes, have confirmed they will appeal the NSW Supreme Court finding. Former Ipswich councillor and flood class action claimant Paul Tully said the appeal process will add to the distress victims have experienced over "nine long and tortuous years. These insurance companies are toying with people's lives and futures," he said in a statement. "They are corporate scumbags just delaying the inevitable. They make Scrooge look like an honourable citizen." The matter is scheduled to return to court on April 29 for further case management.
