21.01.2022 Its important for those genuinely affected by Covid to receive support, with the burden fairly shared by both tenants and owners. However the application of overly generalised rules, particularly in the commercial property market through the Commercial Tenancies (Covid-19 Response) Act 2020, in our view hasn't always been equitable across our local property market and it seems that a number of other professionals share this point of view. 05.01.2022 Commercial Tenancies- Leasing Principles During Covid-19. Whilst we still wait for State Government legislature, the National Cabinet has released the guiding principles of mandatory rent relief arrangements between Landlords and Tenants. (who meet relevant criteria.) A link to the full code of conduct is below. Our take away of the key points; i.The amount of relief is proportionate to the decline in revenue of the Tenant. ii. A minimum of 50% of the 'relief' must be as wa...ived rent, the balance may be deferred. iii. With a minimum requirement that 50% of the rent relief is 'waived rent' (non recoverable, despite the banks simply deferring payments and capitalising interest) it is clear the burden of this rent relief package ultimately falls on the Landlord.
