24.01.2022 Do you have a family company? If you have deposited personal funds into your company, this often creates a loan from you to the company. While the assets of your family company won’t form part of your estate, loans by you to the company will, and these moneys can be called upon by your executor. ... When preparing a Will, care must be taken to ensure that your death will not create a sudden need for the company to sell significant assets in order to repay the loan to your estate. Conversely, if you have withdrawn funds from your family company as a loan, this will generally be a liability of your estate and will need to be repaid to the company following your death. 01.01.2022 A person who has possession or control of a deceased person’s Will must allow certain people to see the Will or be given copies of the Will including: Any person named in the latest Will Any person named as a beneficiary in an earlier Will The surviving spouse (including de-facto) or issue (child, grandchild etc) of the deceased Parent or guardian of the deceased... Any person (including a creditor) who has or may have a claim against the deceased An attorney under an enduring power of attorney made by the deceased. The law also provides that a Will, once admitted to probate, is a public document and that anybody is entitled to apply for a copy of it from the Supreme Court of NSW. If you are a person who is entitled to inspect or receive a copy of the Will of a deceased person, the following options are available to you: Contact the executor or anyone you think may have possession of the Will and request a copy Contact the executor’s solicitors to request a copy of the Will Contact the NSW Supreme Court Private Registry to find out if the Court has a copy of the Will in their records. In some cases, it may be necessary to lodge a caveat to protect your interests. A probate caveat is a document that is filed in Court to prevent the proposed executors or administrators from getting permission to deal with the deceased person’s estate. You should seek legal advice before lodging a caveat as lodging a caveat in the wrong circumstances may lead to a Court ordering that you pay the costs incurred by the other party in dealing with the caveat.
