25.01.2022 Nick Crawford is the partner of the RCR Criminal Lawyers. 24.01.2022 In April our client was remanded in custody with Police alleging he sped down his driveway towards 4 Police officers at speed. He was shot at 5 times and pursued down the Bunya Highway in Kingaroy. He was charged with acts intended to cause grievous bodily harm (max penalty of life imprisonment) and other driving, drug and weapons offences. Zoe Kansky reviewed the brief and negotiated the charge down to a dangerous operation of a motor vehicle (max of 3 years imprisonment) as intent to harm the Officers could not be made out. Zoe appeared in the Kingaroy Magistrates Court on Thursday and our client was sentenced to 18 months imprisonment with immediate parole release after having served 5 months in jail. This was an excellent result with the client having to serve less than a third of his head sentence.
23.01.2022 On 9 February, Nick Crawford appeared instructing Scott Lynch of Counsel in the Supreme Court for our client charged with money laundering. This offence carries a maximum term of imprisonment of 20 years. Our client plead guilty to recklessly money laundering almost $200,000.00 across three bank accounts. She had no previous criminal history and was sentenced to a period of two years imprisonment, wholly suspended for a period of two years.

21.01.2022 Commercial possession of MDMA In November 2019, our client was arrested in possession of some 47 capsules of MDMA near a nightclub in the Mackay CBD. A brief of evidence was sought and submissions made by Nick Crawford resulted in the matter being dealt with on a summary basis before the Magistrates Court instead of before the Mackay Supreme Court. On 25 August 2020, Nick Crawford appeared before the Mackay Magistrates Court, our client pleaded guilty to 1 x Possession of Dangerous Drugs and 1 x Obstruct and was sentenced to 9 months Probation with no conviction being recorded.
21.01.2022 Friday Wrap Up: Nicholas Crawford appeared instructing counsel Nicholas Brown before the Brisbane Supreme Court on 17 November 2020. The most serious charges our client faced was possession of 10.212 grams of pure methylamphetamine and 14.45 grams of pure MDMA. Our client was sentenced to a head sentence of 3 years imprisonment with immediate parole release. Our client was grateful to remain in the community in the circumstances. Following a search warrant in September, her client was charged with a number of offences including possession of the dangerous drugs: methylamphetamine, MDMA, cocaine, Xanex, Valium and GHB. Her client was also charged with the possession of used pipes, bongs, digital scales, restricted drugs and $1900 in Australian currency. Sam O’Connor successfully advocated a good behaviour bond with a condition to attend a Drug and Alcohol Assessment Referral (DAAR) course was the appropriate penalty. 18.01.2022 Friday Wrap Up: This week, a successful submission sent by Sam O’Connor of our office resulted in Police Prosecutions agreeing to discontinue one charge of Unlawful use of motor vehicle and a charge of Acts Intended to cause GBH or transmit serious disease. The charge of Acts intended to cause grievous bodily harm is a serious offence carrying a maximum penalty of life imprisonment. It was alleged by police that our client attempted to shoot the complainant with a projectile shot from a firearm.

A thank you email from Mum for a great result for her 21 year son sentenced in the Brisbane Magistrates Court this week. Our client was given a significant discount at sentence due to his early plea, youth and engagement with mental health services.
17.01.2022 No Jail for 8.9gram Possession on Probation: Zoe Kansky represented a 38-year old client in the Richlands Magistrates Court for possessing 8.9g of methylamphetamine. The offence was committed whilst on probation but after lengthy submissions on recent case comparatives and rehabilitation efforts, her client stayed out of custody and sentenced to immediate parole. This was an excellent result and fast resolution for the client as any possession over 2 grams must generally be dealt with in the Supreme Court.
16.01.2022 Client released on Supreme Court Bail Zoe Kansky obtained Supreme Court bail with strict conditions on Monday for a client charged with over 100 drug offences. Our client was released from custody to enter a full-time residential rehabilitation program while his matter progresses through the Southport Magistrates Court.

Nick Crawfords client was charged with possession of over 1kg of Methamphetamine and possessing several firearms. His lengthy submission was accepted resulting in all charges being discontinued on Wednesday before the Supreme Court. Tyronne Thomas appeared instructing Scott Lynch of Counsel in the District Court for a client charged with Cannabis Trafficking over a 9 month period moving 41 kilograms of drugs. After lengthy submissions, he received 3 years imprisonment with an immediate release on parole. On Friday, Zoe Kansky successfully obtained bail in the Magistrates Court for a young client with 22 outstanding charges and obtained a short suspended sentence for a client who scaled the Capricornia Jail roof whilst in custody. - Beenleigh Magistrates Court Nick Crawford successfully negotiated with Beenleigh Police Prosecutions to have an arson of a vehicle and two break and enter charges discontinued. - St George Magistrates Court Tyronne Thomas instructing Nick Brown of Counsel appeared with a charged with unlawfully supplying firearms and possessing 10 or more firearms and entered successful negotiations with Prosecutions resulting in the discontinuance of the charges.

Here is this weeks Friday wrap up: - Brisbane Supreme Court In April 2018, our 25 year old client was charged with trafficking in Dangerous Drugs for a period of 12 months. Nick Crawford negotiated the trafficking period down to 4 months and listed the matter for sentence. Nick Brown of Counsel appeared with us and our client received a head sentence of 3 years and released on immediate pa...role with time served. - Maroochydore District Court On Monday, Tyronne successfully argued that his client should be granted bail pending her appeal from her sentence in the Magistrates Court at Nambour where she was sentenced to actual imprisonment. It was argued at the application that the Magistrates sentence was manifestly excessive and that she should have been given the opportunity of immediate parole. She was released from custody. - Dalby Magistrates Court Tyronne appeared before the Dalby Magistrates Court on Wednesday. After successful negotiations with Prosecutions, 26 of his clients charges were discontinued including weapons supply and break and enter offences. His client entered pleas of guilty to 38 offences in total, all of which were committed while he was on parole. Tyronne managed to convince the Magistrate to release him on a suspended sentence, which means he wont have to stay in custody any longer and apply for parole.

11.01.2022 On Tuesday, 1 December, Tyronne Thomas appeared before the Beenleigh Magistrates Court for a client charged with numerous domestic violence offences, including assault. He was in a show-cause situation by virtue of the legislation, which means the onus is on the defendant to prove why his continued incarceration was not justified. After submissions, Tyronne was able to persuade the Magistrate to grant him bail. The same day, Tyronne Thomas appeared instructing Counsel before ...the Beenleigh District Court. His client entered pleas of guilty to over 50 property offences including numerous Burglaries, dangerously operating a motor vehicle and unlawfully using motor vehicle charges. The total damage caused by his client’s offending was in excess of $50,000, offending which usually attracts a sentence involving a parole eligibility date. After submissions from Counsel, the Presiding Judge gave our client a combination of a suspended sentence and parole to ensure that he was given a certainty of release. He will be released on this suspended sentence and court ordered parole on 12 January 2021. See more

Nick Crawford negotiated with the Prosecution resulting in the discontinuance of the trafficking and supply charge. The remaining exceed schedule possession breached a suspended sentence before the Supreme Court from 2019. The matter was finalised this week and our client received 4 years imprisonment with parole eligibility in September 2020. Considering all of the circumstances this was an excellent result.
10.01.2022 Very busy this week with 54 court appearances, heres this weeks wrap up: Brisbane Supreme Court On Monday, our 23 year old client was remanded in custody on a Notice to Appear for one dangerous operation of a motor vehicle charge in the Richlands Magistrates Court. Zoe Kansky appeared at an urgent Supreme Court bail application and our client was released on Wednesday afternoon. ... Zoe Kansky appeared instructing Counsel in the Supreme Court on Wednesday and Thursday for drug sentences. Her first client plead guilty to trafficking in methylamphetamine and related drugs and weapons offences after spending 8 months in custody and 5 months in residential rehabilitation. Her second client plead guilty to possessing 10 grams of pure methylamphetamine and a small quantity of cannabis. Both clients received immediate parole release on the day of sentence with no additional time served. This was an excellent result given both offences carry a maximum term of imprisonment of 25 years. Southport District Court Our client was initially charged with home invasion, submissions were made and accepted to Southport DPP resulting in the charge being reduced to a burglary and wilful damage. Nick Crawford instructed Counsel in the District Court and our client was sentenced to a wholly suspended term of imprisonment.

After hearing submissions and case comparatives, our client, 25 year old man from Kallanghur was sentenced to 2 years imprisonment with immediate parole. - Caboolture Magistrates Court Sam OConnor attended the Caboolture Magistrates Court for a lengthy sentence this morning. Her client was sentenced to a suspended sentence and was released from custody for 13 offences.

04.01.2022 Friday Wrap Up: - Rockhampton Supreme Court This week on Wednesday Sam O’Connor attended Rockhampton Supreme Court to appear to instruct Counsel for a Supreme Court sentence. Her client was sentenced in relation to possessing 5.978 pure grams of the dangerous drug methylamphetamine for a commercial purpose. She was sentenced to 2 years imprisonment with court ordered parole in December of this year. - Sandgate Magistrates Court... Sam O’Connor appeared before the Sandgate Magistrates Court on behalf of her client on Thursday of this week. Her client was sentenced in relation to an attempted enter premises of an Audi vehicle. Her client had a 9 page criminal history and was 21 years of age. Her client was on three parole orders at the time of the commission of the offence. The Magistrate sentenced her client to 9 months imprisonment was appropriate with immediate parole eligibility. See more
02.01.2022 This week, Zoe Kansky negotiated the discontinuance of serious charges for her client. The client was charged with drug trafficking in methylamphetamine for an 8-month period. Trafficking in dangerous drugs has a maximum penalty of 25 years imprisonment. The evidence relied upon by the Police was contained in telephone intercepts and downloads. Upon review of the brief of evidence, there was nothing to suggest that her client was ‘carrying on the business’ of trafficking as required in the legislation. After negotiation, the Prosecution agreed to substitute the charge to three isolated supply charges. This is an excellent result for the client moving forward as the charges now accord with her offending.
02.01.2022 Brisbane District Court Trial In October 2020, Sam O’Connor of our office was involved in a trial before the Brisbane District Court. Her client was charged with offences of Sexual Assault and Rape from December 2009. Initially her client had participated in an interview with police shortly after the alleged offences in 2009 providing his version of events. At that time, our client was advised by police the decision had been made not to prefer charges based on the sufficien...cy of evidence test. In March of 2019, the police investigation was re-opened and our client was charged with the alleged offences from 2009. Following a review of the brief, our office requested disclosure regarding the internal QPS documents relating to the original investigation the decision to re-open the matter. The matter proceeded to trial before the Brisbane District Court. At the conclusion of the Crown’s evidence a no-case submission was made by Counsel briefed in the matter. Ultimately, the Presiding Judge agreed that there was no case to answer based on the evidence presented to the Court regarding consent and mistake of fact. The jury was directed by the Judge to give a verdict of not guilty. Our client was acquitted of all Counts on the indictment. It was an outstanding outcome for our client as it gave him the opportunity to move on with his life.
02.01.2022 Recent matters resolved by way of successful submissions: - Sam OConnor of our office sent a submission to police seeking the return of $7300 seized from our clients vehicle in June 2020. In summary, Sam submitted the currency was derived from a legitimate source and was not subject to any charge. The submission was ultimately successful which will result in the return of the money to our client. - Our 37 year old client was charged with assault occasioning bodily harm a...s the result of a fight with a neighbour. Our client strongly contested the charge, Zoe Kansky and Nick Crawford reviewed the brief of evidence finding that our client was provoked and defending himself. Police Prosecutions accepted our submission and the offence was dropped to a public nuisance ticket in the Redcliffe Magistrates Court. 01.01.2022 Clients charges discontinued following Mental Health Court hearing: Tyronne Thomas appeared instructing counsel before the Mental Health Court on Monday, 17 August. After submissions, the Mental Health Court determined that our client was of unsound mind at the time of committing her offences. The charges will therefore be discontinued against her. Client granted immediate parole for wounding charge: Tyronne Thomas appeared instructing Counsel before the Brisbane District ...Court on Friday for a client charged with wounding. Our client was granted an immediate release on parole after persuading the court that he had made significant steps to rehabilitate himself. 01.01.2022 On Tuesday, Sam O’Connor appeared on behalf of her client before the Brisbane Magistrates Court for the purposes of a bail application. Her client was in a show cause position and charged with serious offences such as trafficking in dangerous drugs. The allegation was that her client was involved in the distribution of wholesale quantities of methylamphetamine. Her client had recently been sentenced to a suspended term of imprisonment for drug offences, had a 5 page criminal history and had previous convictions for failing to appear and breaching bail conditions. Sam successfully argued that cause could be shown through the imposition of strict conditions and bail was granted with conditions.
